An Act to impose large‑scale generation shortfall charge, and for related purposes
1 Short title
This Act may be cited as the Renewable Energy (Electricity) (Large‑scale Generation Shortfall Charge) Act 2000.
2 Commencement
This Act commences at the same time as section 1 of the Renewable Energy (Electricity) Act 2000.
3 Definitions
An expression used in this Act and in the Renewable Energy (Electricity) Act 2000 has the same meaning in this Act as it has in that Act.
4 Act to bind Crown
This Act binds the Crown in right of each of the States, of the Australian Capital Territory and of the Northern Territory. However, it does not bind the Crown in right of the Commonwealth.
5 Imposition
The large‑scale generation shortfall charge that is payable under the Renewable Energy (Electricity) Act 2000 is imposed by this section.
6 Rates of charge
(1) The rate of charge is $65 per MWh.
7 Act does not impose a tax on property of a State
(1) This Act does not impose a tax on property of any kind belonging to a State.
(2) In this section:
property of any kind belonging to a State has the same meaning as in section 114 of the Constitution.
