FUEL AND POWER EMERGENCY

Act No. 5 of 1974.

AN ACT TO CONFER POWERS TO REGULATE THE SUPPLY, DISTRIBUTION AND USE OF FUEL AND POWER DURING AN EMERGENCY RELATING TO FUEL AND POWER, AND MATTERS INCIDENTAL THERETO

[8th March, 1974]

Short title

1. This Act may be cited as the Fuel and Power Emergency Act.

Interpretation

2. In this Act, unless the context otherwise requires –

"fuel" includes any oil, matter, liquid or spirit derived wholly or in part from any petroleum, shale, coal, peat, bitumen or any similar substance;

"Fuel Controller" means the person appointed to be the Fuel Controller under section 4;

"power" includes electrical energy when generated, transmitted, supplied or used for any purpose.

Regulations

3. Notwithstanding the provisions of any other written law and of any grant, licence, permit, concession or authority granted thereby or made thereunder, whenever the Minister is satisfied that an emergency has arisen or is threatened relating to the supply, distribution or use of fuel and power he may make regulations with respect to such supply, distribution or use or the movement or means of transport including the power to require any person to furnish, keep and produce any information or records in connection therewith.

Fuel Controller

4. There shall be appointed by the Minister a person to be called the Fuel Controller who shall carry out the functions assigned to him either by any regulations made under this Act or by any other written law.

Fuel Advisory Committee

5. The Minister may appoint a committee, to be called the Fuel Advisory Committee, of not more than five persons to advise the Fuel Controller in relation to the performance of his functions.

Penalty

6. Any person who infringes or contravenes any regulation made under this Act or any order made under any such regulation shall be guilty of an offence and shall be liable to a fine not exceeding two thousand dollars or to imprisonment for a term not exceeding two years or to both such fine and imprisonment.

SECTION 3 – FUEL AND POWER EMERGENCY REGULATIONS

The Fuel and Power Emergency Regulations (14 March 1974) were revoked by the Fuel and Power Emergency Regulations 1979 (Legal Notices Nos. 135 of 1979 and 176 of 1979). The latter Regulations expired on 31 July 1980 (see regulation 1).
