NS/RKT/1204/048 dated December 4, 2004 on the Establishment of

Rural Electrification Fund of the Kingdom of Cambodia, and Article 4 new of the Royal Decree No. NS/RKT/0108/064 dated January 28, 2008 on Revision of Article 4 of the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia

- Seen the Royal Decree No. NS/RKT/0908/1055 dated September 25, 2008 on the Appointment of the Royal Government of Cambodia;

- Seen the Royal Kram No. 02/NS/94 dated July 20, 1994 promulgating the Law on the Organization and Functioning of the Council of Ministers;

- Seen the Royal Kram No. NS/RKM/0196/05 dated January 24, 1996 promulgating the Law on the Establishing of the Ministry of Industry, Mines and Energy;

- Seen the Royal Kram NS/RKM/0201/03 dated February 02, 2001 promulgating the Electricity Law of the Kingdom of Cambodia;

- Seen the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia;

- Seen the Royal Decree No. NS/RKT/0108/064 dated January 28, 2008 on Revision of Article 4 of the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia

- Seen the requests of the Samdech Akakmohasenapadeitechor Hun Sen, Prime Minister of the Kingdom of Cambodia and the Minister of the Ministry of Industry, Mines and Energy.

DECIDE

Article One._

Article 2, Article 5, and Article 7 of the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia, and Article 4 new of the Royal Decree No. NS/RKT/0108/064 dated January 28, 2008 on Revision of Article 4 of the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia is revised as follows:

Article 2 New._

REF shall be managed by Electricité du Cambodge. REF shall function in a non-profit manner and shall have separate account.

Article 4 New._

REF shall be managed in accordance with the Statute of Electricité du Cambodge.

Article 5 New._

The sources of fund for REF are as follows:

Social budget package provided in electricity tariff of EDC and other donations of EDC, if any.
Donations and grants whose sources and terms are acceptable to the Ministry of Industry, Mines and Energy (MIME) and the Ministry of Economy and Finance (MEF).
Other sources from RGC.

Article 7 New._

Article 7 of the Royal Decree No. NS/RKT/1204/048 dated December 4, 2004 on the Establishment of Rural Electrification Fund of the Kingdom of Cambodia shall be null and void.

Article Two._

Samdech Akakmohasenapadeitechor Hun Sen, Prime Minister of the Kingdom of Cambodia shall be in charge of effective implementation of this Royal Decree.

Article Three._

This Royal Decree shall come into force from the date of signing.
