ADMINISTRATIVE ORDER
No. 2017 - 14 MAY 02 2017
SUBJECT: ONLINE TRANSMISSION OF DATA FROM CONTINUOUS EMISSION MONITORING SYSTEM (CEMS) AND CLOSED CIRCUIT TELEVISION (CCTV) OF MAJOR INDUSTRIES
In view of effective monitoring of CEMS and CCTV implementation of major industries pursuant to provision of Republic Act 8749 and its Implementing Guidelines under DENR Administrative Orders 2000-81 and 2007-22, and for effective monitoring of proponent's compliance as provided in the Environmental Compliance Certificate (ECC) under PD 1 586, the following guidelines are hereby issued:
Section 1. Objectives
1. Establish an online information database system for efficient and effective monitoring of proponent's commitments in the Environmental Compliance Certificate (ECC) and Environmental Management Plan (EMP).
2. Immediately respond/verify any deviation from the air quality standards.
Section 2. Scope and Coverage
In order to achieve the objectives of this Order, the proponent is require to transmit data/images from its CEMS/CCTV to EMB online information database system. It shall cover all Environmentally Critical Projects with individual air emission equipment having the potential t emit at least 750 tons per year of any regulated pollutants listed in Section 4 of Rule IX of DENR Administrative Order 2000-81.
Section 3. Operation of online information database system
1. The EMB shall provide the industry an Internet Protocol(IP) address of a secure File Transfer Protocol (FTP) server together with users credentials.
2. The proponent shall configure their emission monitoring system to transmit hourly average air quality data on daily basis to the EMB FTP server. Transmitted data should be in excel, or other equivalent spreadsheet format.
3. The proponent shall configure their CCTV system to transmit real time images (hourly) of stack emission to EMB FTP server.
All data or real-time images shall be transmitted online including during breakdown of air pollution control facility (APCF). Likewise, breakdown and/or non-operation of pollution source equipment or breakdown of air pollution control facility shall also be reported through online system. Otherwise, this Office will consider the submission of data/ images incomplete.
Section 4. Data Storage
The collected data shall be stored in the server located in EMB Data Center.
Section 5. Penalty
The following shall constitute a violation on the part of the proponent:
1. Incomplete online reporting of air pollution parameters data as prescribed in their Environmental Management Plan and existing guidelines, rules and regulations. At least 75% captured data shall be submitted through online.
2. Failure to transmit real-time images of stack emission from CCTV to EMB server as required by existing laws, rules and regulations.
A maximum of PhP 50,000.00 pesos of fine shall be imposed against the proponent for every violation committed hereof. The following are the schedule of fines in accordance to PD 1586 and its IRR:

Section 6. Repealing Clause
All issuances inconsistent herewith is hereby repealed, superseded and/or modified accordingly.
If any provision of this Administrative Order is declared unconstitutional or invalid by a competent court, other sections or provisions hereof which are not affected thereby shall continue to be in full force and effect as if the provisions/sections so cancelled had never been incorporated herein.
Section 7. Effectivity
This Administrative Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation and upon acknowledgment of receipt of a copy thereof by the Office of the National Administrative Register (ONAR), UP Law Center.
