Ministerial Regulation No. 2 B.E. 2539 (1996)
Issued pursuant to the Energy Development and Promotion Act B.E. 2535 (1992)
By the virtue of section 25 paragraph two and section 41 of the Energy Development and Promotion Act B.E. 2535 (1992), the Minister of Science, Technology and Environment, hereby issues the Ministerial Regulation as follows:
Clause 1 Anyone who wishes to apply for a permit for production or expansion of regulated energy shall submit an application using the Form Por.Kor.1 annexed to this Ministerial Regulation.
Clause 2 Permission to produce or expand production of regulated energy shall use the Form Por.Kor.2 annexed to this Ministerial Regulation as a permit.
Permission as described in paragraph one shall be valid for a period of not more than four years at a time since the date of permission.
Clause 3 Anyone who has obtained a permit to produce regulated energy and wishes to obtain a permit for an extended period, shall submit an application using the Form Por.Kor.1 not less than one hundred and twenty days before the original permit expires.
Clause 4 Permission for further production of regulated energy shall be shown in the last item of the original permit or a new permit shall be issued.
Clause 5 Upon receipt of an application in accordance with Clause 1 or Clause 3, if the officer considers it necessary to request an original or copy of documents or other evidences besides those mentioned, the officer shall notify in writing to the applicant, who will then be required to submit the original or a copy of the documents or evidences to the authority within a reasonable period of time.
Clause 6 An application form for the aforementioned permit in accordance with this Ministerial Regulation shall be submitted to an officer at the Bureau of Energy Regulation and Conservation, Department of Energy Development and Promotion, or at the Regional Office of Energy Development and Promotion in the area where that particular source of regulated energy production is located.
