第一章 総則
Chapter I General Provisions
（目的）
(Purpose)
第一条 この法律は、熱供給事業の運営を適正かつ合理的ならしめることによつて、熱供給を受ける者の利益を保護するとともに、熱供給事業の健全な発達を図り、並びに熱供給施設の工事、維持及び運用を規制することによつて、公共の安全を確保することを目的とする。
Article 1 The purpose of this Act is to protect the interests of persons who receive heat supply and to achieve the sound development of heat supply business by realizing appropriate and reasonable operation of heat supply business, and to assure public safety by regulating the construction, maintenance and operation of heat supply facilities.
（定義）
(Definitions)
第二条 この法律において「熱供給」とは、加熱され、若しくは冷却された水又は蒸気を導管により供給することをいう。
Article 2 (1) The term "heat supply" as used in this Act shall mean supplying heated or cooled water or steam through pipelines.
２ この法律において「熱供給事業」とは、一般の需要に応じ熱供給を行なう事業（使用するボイラーその他の政令で定める設備の能力が政令で定める基準以上のものに限り、もつぱら一の建物内の需要に応じ熱供給を行なうものを除く。）をいう。
(2) The term "heat supply business" as used in this Act shall mean the business of supplying heat to meet general demand (limited to such business that uses boilers and other facilities specified by a Cabinet Order with a capacity larger than the standards specified by a Cabinet Order, and excluding such business exclusively for supplying heat to meet the demand in a single building.
３ この法律において「熱供給事業者」とは、次条の許可を受けた者をいう。
(3) The term "heat supply operator "as used in this Act shall mean the person who has obtained a license under the next Article.
４ この法律において「熱供給施設」とは、熱供給事業の用に供されるボイラー、冷凍設備、循環ポンプ、整圧器、導管その他の設備であつて、熱供給事業を営む者の管理に属するものをいう。
(4) The term "heat supply facilities" as used in this Act shall mean boilers, refrigeration facilities, circulating pumps, governors, pipelines and any other facilities used for heat supply business, which are under control of a person who conducts a heat supply business.
第二章 事業の許可
Chapter II Business License
（事業の許可）
(Business License)
第三条 熱供給事業を営もうとする者は、供給区域ごとに、経済産業大臣の許可を受けなければならない。
Article 3 A person who intends to conduct a heat supply business shall obtain a license from the Minister of Economy, Trade and Industry for each service area.
（許可の申請）
(Application for License)
第四条 前条の許可を受けようとする者は、次の事項を記載した申請書を経済産業大臣に提出しなければならない。
Article 4 (1) A person who intends to obtain a license under the preceding Article shall submit a written application to the Minister of Economy, Trade and Industry, stating:
一 氏名又は名称及び住所並びに法人にあつてはその代表者の氏名及び住所
(i) The name and address of the applicant, as well as the name and address of the representative if the applicant is a juridical person.
二 供給区域
(ii) The service area
三 熱供給施設に関する次の事項
(iii) The following matters concerning heat supply facilities:
イ ボイラー、冷凍設備その他の政令で定める設備にあつては、その設置の場所、種類及び能力
(a) Regarding boilers, refrigeration facilities and other facilities specified by a Cabinet Order, the site where they are to be installed, and the type and capacity thereof
ロ 経済産業省令で定める導管にあつては、その設置の場所及び内径並びに導管内における水又は蒸気の温度及び圧力
(b) Regarding pipelines specified by an Ordinance of the Ministry of Economy, Trade and Industry, the site where they are to be installed and the inside diameter thereof, as well as the temperature and pressure of heat or steam within the pipelines.
２ 前項の申請書には、事業計画書その他経済産業省令で定める書類を添附しなければならない。
(2) The written application set forth in the preceding paragraph shall be accompanied by a business plan, and other documents specified by an Ordinance of the Ministry of Economy, Trade and Industry.
（許可の基準）
(Standards for License)
第五条 経済産業大臣は、第三条の許可の申請が次の各号（その申請が地方公共団体によつてされたものであるときは、第一号、第四号及び第五号）に適合していると認めるときでなければ、同条の許可をしてはならない。
Article 5 The Minister of Economy, Trade and Industry shall not grant a license under Article 3 unless he/she finds that the application for the license under the said Article conforms to the following items (or, if the application is filed by a local public entity, item (i), item (iv) and item (v)).
一 その熱供給事業の開始が一般の需要に適合すること。
(i) The commencement of the heat supply business corresponds to general demand.
二 その熱供給事業の熱供給施設の能力がその供給区域における熱供給に対する需要に応ずることができるものであること。
(ii) The heat supply facilities for the heat supply business are capable of meeting demand for heat supply in the service area.
三 その熱供給事業を適確に遂行するに足りる経理的基礎及び技術的能力があること。
(iii) The applicant has sufficient financial basis and technical capability to perform the heat supply business properly.
四 その熱供給事業の計画が確実かつ合理的であること。
(iv) The heat supply business is based on a reliable and reasonable plan.
五 その他その熱供給事業の開始がその供給区域における日常生活又は事業活動上の利便の増進のため必要であり、かつ、適切であること。
(v) The commencement of the heat supply business is necessary and appropriate for improving the convenience in daily life or business activities in the service area.
（熱供給施設の設置及び事業の開始の義務）
(Obligation to Install Heat Supply Facilities and Commence Business)
第六条 地方公共団体以外の熱供給事業者は、三年以内において経済産業大臣が指定する期間（新住宅市街地開発法 （昭和三十八年法律第百三十四号）による新住宅市街地開発事業の施行に伴い熱供給施設を設置する場合であつて、その設置に特に長期間を要すると認められるときは、経済産業大臣が指定する期間）内に、熱供給施設を設置し、その事業を開始しなければならない。
Article 6 (1) A heat supply operator other than a local public entity shall install heat supply facilities and commence its business within the period designated by the Minister of Economy, Trade and Industry, but not to exceed three years (or if heat supply facilities are to be installed along with the implementation of a New Housing and Urban Development Project under the New Housing and Urban Development Act (Act No. 134 of 1963) and it is determined that a particularly long period of time will be required for installation, then within the period designated by an Ordinance of the Ministry of Economy, Trade and Industry).
２ 経済産業大臣は、特に必要があると認めるときは、供給区域又は熱供給施設を区分して前項の規定による指定をすることができる。
(2) The Minister of Economy, Trade and Industry may, when he/she finds it particularly necessary, designate the period set forth in the preceding paragraph by category of service area or heat supply facility.
３ 経済産業大臣は、地方公共団体以外の熱供給事業者から申請があつた場合において、正当な理由があると認めるときは、第一項の規定により指定した期間を延長することができる。
(3) Where the Minister of Economy, Trade and Industry has received an application from a heat supply operator other than a local public entity, he/she may, when finding justifiable grounds, extend the period designated under paragraph (1).
４ 熱供給事業者は、その事業（第二項の規定により供給区域を区分して第一項の規定による指定があつたときは、その区分に係る事業）を開始したときは、遅滞なく、その旨を経済産業大臣に届け出なければならない。
(4) A heat supply operator shall, when having commenced its business (in the cases where the designation set forth in paragraph (1) has been made by category of service area pursuant to paragraph (2), the business corresponding to that category), notify the Minister of Economy, Trade and Industry to that effect without delay.
（供給区域等の変更）
(Change of Service Area, etc.)
第七条 熱供給事業者は、第四条第一項第二号又は第三号の事項を変更しようとするときは、経済産業大臣の許可を受けなければならない。ただし、同項第三号の事項の変更であつて、経済産業省令で定める軽微なものをしようとするときは、この限りでない。
Article 7 (1) A heat supply operator shall, when intending to change the matters listed in Article 4, paragraph (1), item (ii) or item (iii), obtain permission from the Minister of Economy, Trade and Industry; provided, however, that this shall not apply to a change to the matter listed in item (iii) of the said paragraph if the matter is a minor one specified by an Ordinance of the Ministry of Economy, Trade and Industry.
２ 熱供給事業者は、前項ただし書の経済産業省令で定める変更をしたときは、遅滞なく、その旨を経済産業大臣に届け出なければならない。
(2) A heat supply operator shall, when having made a change specified by an Ordinance of the Ministry of Economy, Trade and Industry set forth in the proviso of the preceding paragraph, notify the Minister of Economy, Trade and Industry to that effect without delay.
３ 第五条の規定は、第一項の許可に準用する。
(3) The provision of Article 5 shall apply mutatis mutandis to the permission set forth in paragraph (1).
４ 前条の規定は、第一項の場合（供給区域の減少の場合を除く。）に準用する。
(4) The provision of the preceding Article shall apply mutatis mutandis to the case referred to in paragraph (1) (excluding, however, the cases of reducing the service area.)
（氏名等の変更）
(Change of Name, etc.)
第八条 地方公共団体以外の熱供給事業者は、その氏名若しくは名称又は住所に変更があつたときは、遅滞なく、その旨を経済産業大臣に届け出なければならない。
Article 8 A heat supply operator other than a local public entity shall, where there has been a change to the name or address thereof, notify the Minister of Economy, Trade and Industry to that effect without delay.
（事業の譲渡し及び譲受け並びに法人の合併及び分割）
(Assignment and Acceptance of Business, and Merger and Split of Juridical Person)
第九条 熱供給事業の全部の譲渡し及び譲受けは、経済産業大臣の認可を受けなければ、その効力を生じない。
Article 9 (1) An assignment and acceptance of the whole of a heat supply business shall not be effective unless approved by the Minister of Economy, Trade and Industry.
２ 熱供給事業者たる法人（地方公共団体を除く。）の合併及び分割（熱供給事業の全部を承継させるものに限る。次条第一項において同じ。）は、経済産業大臣の認可を受けなければ、その効力を生じない。ただし、熱供給事業者たる法人が熱供給事業者でない法人を合併する場合は、この限りでない。
(2) A merger and split of a juridical person as a heat supply operator (excluding a local public entity) (limited to merger or split resulting in the taking over of the whole of a heat supply business; hereinafter the same shall apply in paragraph (1) of the next Article) shall not be effective unless approved by the Minister of Economy, Trade and Industry; provided, however, that this shall not apply where a juridical person as a heat supply operator merges a juridical person that is not a heat supply operator.
３ 第五条第三号の規定は、前二項の認可に準用する。
(3) The provisions of Article 5, item (iii) shall apply mutatis mutandis to the approval set forth in the preceding two paragraphs.
（承継）
(Succession)
第十条 熱供給事業の全部の譲渡しがあり、又は熱供給事業者について相続、合併若しくは分割があつたときは、熱供給事業の全部を譲り受けた者又は相続人、合併後存続する法人若しくは合併により設立した法人若しくは分割により当該熱供給事業の全部を承継した法人は、当該熱供給事業者の地位を承継する。
Article 10 (1) In the event of an assignment of the whole of a heat supply business, or inheritance, merger or demerger of a heat supply operator, the assignee of the whole of the heat supply business, the heir, the juridical person surviving after the merger or the juridical person newly established upon the merger, or the juridical person who has taken over the whole of the heat supply business upon the demerger shall succeed to the status of the heat supply operator.
２ 前項の規定により熱供給事業者の地位を承継した相続人は、遅滞なく、その旨を経済産業大臣に届け出なければならない。
(2) The heir who has succeeded to the status of a heat supply operator pursuant to the preceding paragraph shall notify the Minister of Economy, Trade and Industry to that effect without delay.
（事業の休止及び廃止並びに法人の解散）
(Suspension and Abolition of Business, and Dissolution of Juridical Person)
第十一条 熱供給事業者は、経済産業大臣の許可を受けなければ、熱供給事業の全部又は一部を休止し、又は廃止してはならない。
Article 11 (1) A heat supply operator shall not suspend or abolish the whole or a part of the heat supply business without obtaining permission from the Minister of Economy, Trade and Industry.
２ 熱供給事業者たる法人の解散の決議又は総社員の同意は、経済産業大臣の認可を受けなければ、その効力を生じない。
(2) A resolution for the dissolution of a juridical person acting as a heat supply operator or consent thereto by all its members shall not be effective unless approved by the Minister of Economy, Trade and Industry.
３ 経済産業大臣は、熱供給事業の休止若しくは廃止又は熱供給事業者たる法人の解散により当該供給区域における日常生活又は事業活動上の利便が著しく害され、又は害されるおそれがあると認めるときは、第一項の許可又は前項の認可をしてはならない。
(3) The Minister of Economy, Trade and Industry shall not grant permission under paragraph (1) or approval under the preceding paragraph if he/she finds that the suspension or abolition of the heat supply business or dissolution of the juridical person as a heat supply operator harms or is likely to harm significantly the convenience in daily life or business activities in the service area.
（事業の許可の取消し）
(Rescission of Business License)
第十二条 経済産業大臣は、熱供給事業者が第六条第一項の規定により指定された期間（同条第三項の規定による延長があつたときは、延長後の期間）内に熱供給施設を設置せず、又は事業を開始しないときは、第三条の許可を取り消すことができる。
Article 12 (1) Where a heat supply operator does not install heat supply facilities or commence its business within the period designated under Article 6, paragraph (1) (if the period has been extended under paragraph (3) of the said Article, within the extended period), the Minister of Economy, Trade and Industry may rescind the license granted under Article 3.
２ 経済産業大臣は、第七条第一項の許可を受けた熱供給事業者が同条第四項において準用する第六条第一項の規定により指定された期間（第七条第四項において準用する第六条第三項の規定による延長があつたときは、延長後の期間）内にその増加する供給区域において事業を開始せず、又はその期間内に第四条第一項第三号の事項を変更しないときは、その許可を取り消すことができる。
(2) Where a heat supply operator that has obtained permission under Article 7, paragraph (1) does not commence its business within the period designated under Article 6, paragraph (1) applied mutatis mutandis pursuant to Article 7, paragraph (4) (or, if the period has been extended under Article 6, paragraph (3) applied mutatis mutandis pursuant to Article 7, paragraph (4), the extended period) in the new service area, or make a change to the matter listed in Article 4, paragraph (1), item (iii) within the said period, the Minister of Economy, Trade and Industry may rescind the permission.
３ 経済産業大臣は、前二項に規定する場合を除くほか、熱供給事業者がこの法律の規定又はこれに基づく処分若しくは第二十五条第一項の規定により附された条件に違反した場合において、当該供給区域における日常生活又は事業活動上の利便を著しく害すると認めるときは、第三条又は第七条第一項の許可を取り消すことができる。
(3) In addition to the cases prescribed in the preceding two paragraphs, where a heat supply operator has violated any provision of this Act or any order issued under this Act or any condition attached pursuant to Article 25, paragraph (1), the Minister of Economy, Trade and Industry may, when he/she finds that such violation significantly harms the convenience in daily life or business activities in the service area, rescind the license granted under Article 3 or permission granted under Article 7, paragraph (1).
４ 経済産業大臣は、前三項の規定による許可の取消しをしたときは、理由を記載した文書をその熱供給事業者に送付しなければならない。
(4) The Minister of Economy, Trade and Industry shall, when having rescinded the license or permission pursuant to any of the preceding three paragraphs, provide a written explanation of the reasons for the rescission to the heat supply operator.
第三章 業務
Chapter III Services
（供給義務）
(Obligation to Supply)
第十三条 熱供給事業者は、正当な理由がなければ、何人に対しても、その供給区域における熱供給を拒んではならない。
Article 13 (1) A heat supply operator shall not refuse to supply heat to any person in its service area without justifiable grounds.
２ 熱供給事業者は、その供給区域に係る熱供給施設を使用してその供給区域以外の地域において、一般の需要に応じ熱供給を行なつてはならない。
(2) A heat supply operator shall not supply heat through pipelines to meet general demand in any area other than its service area using the heat supply facilities installed for its service area.
（供給規程）
(General Supply Provision)
第十四条 地方公共団体以外の熱供給事業者は、熱供給の料金その他の供給条件について供給規程を定め、経済産業大臣の認可を受けなければならない。これを変更しようとするときも、同様とする。
Article 14 (1) A heat supply operator other than a local public entity shall provide for general conditions with regard to rates and other supply conditions for heat supply, and obtain approval of the said conditions from the Minister of Economy, Trade and Industry. The same shall apply if the said heat supply operator is to revise the said conditions.
２ 経済産業大臣は、前項の認可の申請が次の各号に適合していると認めるときは、同項の認可をしなければならない。
(2) The Minister of Economy, Trade and Industry shall, when he/she finds that the application for the approval under the preceding paragraph conforms to the following items, grant approval under the said paragraph.
一 料金が能率的な経営の下における適正な原価に照らし公正妥当なものであること。
(i) The rates are equitable and reasonable in light of fair costs incurred as a result of efficient management
二 料金の額の算出方法が適正かつ明確に定められていること。
(ii) The method for calculating the amount of rates is provided for appropriately and clearly.
三 熱供給事業者及び熱供給を受ける者の責任に関する事項並びに導管、熱量計その他の設備に関する費用の負担の方法が適正かつ明確に定められていること。
(iii) The responsibilities of the heat supply operator and persons who receive heat supply, as well as the method of sharing expenses between them for pipelines, calorimeters and other facilities, are provided for appropriately and clearly.
四 特定の者に対し不当な差別的取扱いをするものでないこと。
(iv) The application does not treat a certain persons in an unjust discriminatory manner.
３ 地方公共団体たる熱供給事業者は、熱供給の料金その他の供給条件について供給規程を定め、あらかじめ、経済産業大臣に届け出なければならない。これを変更しようとするときも、同様とする。
(3) A heat supply operator that is a local public entity shall provide for general conditions with regard to rates and other supply conditions for heat supply, and notify the Minister of Economy, Trade and Industry of the said conditions in advance. The same shall apply if the said heat supply operator is to revise the provisions.
４ 前項の供給規程は、第二項各号に適合するものでなければならない。
(4) The general supply provisions set forth in the preceding paragraph shall conform to the items of paragraph (2).
５ 熱供給事業者は、第一項の認可を受けた供給規程（第十六条第二項の規定による変更があつたときは、変更後の供給規程）又は第三項の規定による届出をした供給規程をその実施の日までに熱供給を受ける者に周知させる措置をとらなければならない。
(5) A heat supply operator shall take measures to have known the general supply conditions approved under paragraph (1) (or, if revision has been made pursuant to Article 16, paragraph (2), the revised general supply conditions) or general supply conditions notified pursuant to paragraph (3), among persons who receive heat supply, no later than the date of implementation of the provisions.
（供給条件についての義務）
(Obligation Regarding Supply Conditions)
第十五条 地方公共団体以外の熱供給事業者は、前条第一項の認可を受けた供給規程（次条第二項の規定による変更があつたときは、変更後の供給規程）以外の供給条件により熱供給を行なつてはならない。ただし、供給規程により難い特別の事情がある場合において、経済産業大臣の認可を受けた料金その他の供給条件により熱供給を行なうときは、この限りでない。
Article 15 (1) A heat supply operator other than a local public entity shall not supply heat under general supply conditions other than those approved under paragraph (1) of the immediate preceding Article (or, if revision has been made pursuant to paragraph (2) of the next Article, the revised general supply conditions); provided, however, that this shall not apply where there are special circumstances that make it difficult to comply with the general supply conditions and the said heat supply operator supplies heat under such rates and other supply conditions as approved by the Minister of Economy, Trade and Industry.
２ 前項の規定は、地方公共団体たる熱供給事業者に準用する。この場合において、同項ただし書中「経済産業大臣の認可を受けた」とあるのは、「あらかじめ、経済産業大臣に届け出た」と読み替えるものとする。
(2) The provision of the preceding paragraph shall apply mutatis mutandis to a heat supply operator that is a local public entity. In this case, the words "approved by the Minister of Economy, Trade and Industry" in the proviso of the said paragraph shall be deemed to be replaced with "for which notification was given to the Minister of Economy, Trade and Industry in advance."
（供給規程に関する命令及び処分）
(Order and Disposition on General Supply Provisions)
第十六条 経済産業大臣は、熱供給の料金その他の供給条件が社会的経済的事情により著しく不適当となり、当該供給区域における日常生活又は事業活動上の利便の増進に支障があると認めるときは、地方公共団体以外の熱供給事業者に対し、相当の期限を定め、第十四条第一項の認可を受けた供給規程（次項の規定による変更があつたときは、変更後の供給規程）の変更の認可を申請すべきことを命ずることができる。
Article 16 (1) The Minister of Economy, Trade and Industry may, when he/she finds that the heat supply rates and/or other supply conditions have become significantly inappropriate as a result of changes in social and economic circumstances to the extent that they hinder the convenience in daily life or business activities in the service area, order a heat supply operator other than a local public entity to apply for approval to revise the general supply conditions approved under Article 14, paragraph (1) (or if revision has been made pursuant to the next paragraph, the revised general supply conditions ), within a reasonable time limit set by the Minister of Economy, Trade and Industry.
２ 経済産業大臣は、前項の規定による命令をした場合において、同項の期限までに認可の申請がないときは、供給規程を変更することができる。
(2) Where the Minister of Economy, Trade and Industry has issued an order pursuant to the preceding paragraph, he/she may, if no application for approval has been filed within the time limit set forth in the said paragraph, revise the general supply conditions.
（温度等の測定義務）
(Obligation to Measure Temperature, etc.)
第十七条 熱供給事業者は、経済産業省令で定めるところにより、その供給する水又は蒸気の温度及び圧力を測定し、その結果を記録しておかなければならない。
Article 17 A heat supply operator shall, pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry, measure the temperature and pressure of the water or steam supplied thereby, and record the values measured.
（業務の方法の改善命令）
(Order for Improvement of Operational Procedure)
第十八条 経済産業大臣は、第十四条第五項の規定による供給規程の周知の措置が適切でないときその他地方公共団体以外の熱供給事業者の業務の方法が適切でないため、当該供給区域における日常生活又は事業活動上の利便の増進に支障があると認めるときは、その熱供給事業者に対し、業務の方法を改善すべきことを命ずることができる。
Article 18 The Minister of Economy, Trade and Industry may, where he/she finds that an inappropriate measure taken by a heat supply operator to publicize the general supply provisions pursuant to Article 14, paragraph (5) or any other inappropriate operational procedure implemented by the said heat supply operator hinders the improvement of the convenience in daily life or business activities in the service area, order the heat supply operator to improve its operational procedures.
（会計の整理）
(Keeping of Accounts)
第十九条 熱供給事業者は、勘定科目の分類その他の会計に関する手続について経済産業省令で定めるところにより、その会計を整理しなければならない。
Article 19 A heat supply operator shall keep accounts pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry with regard to the classification of items of accounts and other accounting procedures.
第四章 保安
Chapter IV Safety Measures
（熱供給施設の維持）
(Maintenance of Heat Supply Facilities)
第二十条 熱供給事業者は、熱供給施設を経済産業省令で定める技術上の基準に適合するように維持しなければならない。
Article 20 (1) A heat supply operator shall maintain heat supply facilities to ensure that they conform to the technical standards established by an Ordinance of the Ministry of Economy, Trade and Industry.
２ 経済産業大臣は、熱供給施設が前項の技術上の基準に適合していないと認めるときは、当該熱供給事業者に対し、その技術上の基準に適合するように熱供給施設を修理し、改造し、若しくは移転すべきことを命じ、又はその熱供給施設の使用の一時停止若しくは使用の制限を命ずることができる。
(2) The Minister of Economy, Trade and Industry may, when he/she finds that heat supply facilities do not conform to the technical standards set forth in the preceding paragraph, order the heat supply operator to repair or renovate the heat supply facilities to ensure conformity to the technical standards, or order the heat supply operator to relocate the heat supply facilities or suspend the use of them, or restrict the heat supply operator from using them.
（導管の工事計画）
(Construction Plan for Pipelines)
第二十一条 熱供給事業者は、熱供給事業の用に供する導管の設置又は変更の工事であつて経済産業省令で定めるものをしようとするときは、その工事の計画を経済産業大臣に届け出なければならない。ただし、当該導管が滅失し、若しくは損壊した場合又は災害その他非常の場合において、やむを得ない一時的な工事としてするときは、この限りでない。
Article 21 (1) A heat supply operator shall, when he/she is to implement such a construction project to install or renovate pipelines to be used for the heat supply business as specified by an Ordinance of the Ministry of Economy, Trade and Industry, notify the Minister of Economy, Trade and Industry of the plans for the said construction project; provided, however, that this shall not apply to any unavoidable work for short period to be implemented in the event of loss of or damage to the pipelines or in the event of a disaster or other emergency.
２ 前項の規定は、同項の規定による届出をした工事の計画の変更（経済産業省令で定める軽微なものを除く。）をしようとする場合に準用する。
(2) The provision of the preceding paragraph shall apply mutatis mutandis where a heat supply operator intends to change the construction plan for which notification was given pursuant to the said paragraph (excluding, however, any minor change specified by an Ordinance of the Ministry of Economy, Trade and Industry).
３ 第一項（前項において準用する場合を含む。）の規定による届出をした者は、その届出が受理された日から三十日を経過した後でなければ、その届出に係る工事を開始してはならない。
(3) A person who has given a notification pursuant to paragraph (1) (including the cases where it is applied mutatis mutandis pursuant to the preceding paragraph) shall not commence the construction work to which the notification pertained until 30 days have elapsed from the day when the notification was received.
４ 経済産業大臣は、第一項（第二項において準用する場合を含む。）の規定による届出のあつた工事の計画が次項各号の規定に適合していると認めるときは、前項に規定する期間を短縮することができる。
(4) The Minister of Economy, Trade and Industry may, when he/she finds that the construction plan for which notification was given pursuant to paragraph (1) (including the cases where it is applied mutatis mutandis pursuant to paragraph (2)) conforms to the items of the next paragraph, shorten the period prescribed in the preceding paragraph.
５ 経済産業大臣は、第一項（第二項において準用する場合を含む。）の規定による届出のあつた工事の計画が次の各号に適合していないと認めるときは、その届出を受理した日から三十日以内に限り、当該熱供給事業者に対し、その工事の計画を変更し、又は廃止すべきことを命ずることができる。
(5) When the Minister of Economy, Trade and Industry finds that the construction plan for which notification was given pursuant to paragraph (1) (including the cases where it is applied mutatis mutandis pursuant to paragraph (2)) fails to conform to the following items, he/she may, within 30 days from the day when the notification is received, order the heat supply operator to revise or abolish the construction plan.
一 第三条又は第七条第一項の許可を受けたところ（同項ただし書の経済産業省令で定める軽微な変更をしたものを含む。）によるものであること。
(i) The construction plan conforms to the licenses or permissions obtained in accordance with Article 3 or Article 7, paragraph (1) (including any such minor change as specified by an Ordinance of the Ministry of Economy, Trade and Industry under the proviso of the said paragraph)
二 当該導管が前条第一項の経済産業省令で定める技術上の基準に適合しないものでないこと。
(ii) The pipelines conform to the technical standards established by an Ordinance of the Ministry of Economy, Trade and Industry under paragraph (1) of the preceding Article.
（導管の使用前自主検査）
(Pre-use Self-Inspection of Pipelines)
第二十二条 熱供給事業者は、前条第一項（同条第二項において準用する場合を含む。）の規定による届出をして設置又は変更の工事をする導管（その工事の計画について、同条第五項の規定による命令があつた場合において同条第二項において準用する同条第一項の規定による届出をしていないものを除く。）について、経済産業省令で定めるところにより、その使用の開始前に、自主検査を行い、その結果を記録しておかなければならない。
Article 22 (1) A heat supply operator shall, with regard to the pipelines to be installed or renovated according to the construction plan for which notification was given pursuant to paragraph (1) of the preceding Article (including the cases where it is applied mutatis mutandis pursuant to paragraph (2) of the said Article) (in the case where an order has been issued with respect to the construction plan relating to pipelines pursuant to paragraph (5) of the said Article, but notification has not yet been given pursuant to paragraph (1) of the said Article as applied mutatis mutandis pursuant to paragraph (2) of the said Article, such pipelines shall be excluded), conduct a self-inspection of the pipelines before commencing the use thereof and record the inspection results, pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry.
２ 前項の検査においては、その導管が次の各号のいずれにも適合していることを確認しなければならない。
(2) In the self-inspection set forth in the preceding paragraph, it is necessary to confirm that the pipelines conform to all of the following items.
一 その工事が前条第一項（同条第二項において準用する場合を含む。）の規定による届出をした工事の計画（同条第二項の経済産業省令で定める軽微な変更をしたものを含む。）に従つて行われたものであること。
(i) The construction project for the pipelines has been implemented according to the construction plan for which notification was given pursuant to paragraph (1) of the preceding Article (including the cases where it is applied mutatis mutandis pursuant to paragraph (2) of the said Article) (including such plan following any minor revision specified by an Ordinance of the Ministry of Economy, Trade and Industry under paragraph (2) of the said Article).
二 第二十条第一項の経済産業省令で定める技術上の基準に適合するものであること。
(ii) The pipelines conform to the technical standards established by an Ordinance of the Ministry of Economy, Trade and Industry under Article 20, paragraph (1).
（保安規程）
(Safety Regulations)
第二十三条 熱供給事業者は、熱供給施設の工事、維持及び運用に関する保安を確保するため、経済産業省令で定めるところにより、保安規程を定め、事業（第二十一条第一項に規定する工事を伴うものにあつては、その工事）の開始前に、経済産業大臣に届け出なければならない。
Article 23 (1) A heat supply operator shall, in order to ensure safety of the construction, maintenance and operation of the heat supply facilities, establish safety regulations pursuant to the provision of an Ordinance of the Ministry of Economy, Trade and Industry, and notify the Minister of Economy, Trade and Industry of the regulations before the commencement of the business (in the case of facilities requiring construction prescribed in Article 21, paragraph (1), before the commencement of the construction of the facilities).
２ 熱供給事業者は、保安規程を変更したときは、遅滞なく、変更した事項を経済産業大臣に届け出なければならない。
(2) A heat supply operator shall, when having revised the safety regulations, notify the Minister of Economy, Trade and Industry of the revised matters without delay.
３ 経済産業大臣は、熱供給施設の工事、維持及び運用に関する保安を確保するため必要があると認めるときは、熱供給事業者に対し、保安規程を変更すべきことを命ずることができる。
(3) The Minister of Economy, Trade and Industry may, when he/she finds it necessary in order to ensure safety of the construction, maintenance, and operation of heat supply facilities, order the heat supply operator to revise the safety regulations.
４ 熱供給事業者及びその従業者は、保安規程を守らなければならない。
(4) A heat supply operator and its employees shall observe the safety regulations.
（熱供給施設に準ずる施設の保安）
(Safety Measures for Facilities Equivalent to Heat Supply Facilities)
第二十四条 第二十条及び第二十一条の規定は、熱供給を行うために使用される導管であつて経済産業省令で定めるもの（熱供給施設に属するものを除く。）を道路その他の経済産業省令で定める場所に設置している者（設置しようとする者を含む。）に準用する。この場合において、第二十条中「熱供給施設」とあり、第二十一条第一項中「熱供給事業の用に供する導管」とあるのは「第二十四条の経済産業省令で定める場所に設置される同条に規定する導管」と、同条第四項中「次項各号」とあるのは「次項第二号」と、同条第五項中「次の各号」とあるのは「第二号」と読み替えるものとする。
Article 24 The provisions of Article 20 and Article 21 shall apply mutatis mutandis to a person who has installed such pipelines to be used for supplying heat as specified by an Ordinance of the Ministry of Economy, Trade and Industry (excluding those that belong to heat supply facilities) under roads or any other places specified by an Ordinance of the Ministry of Economy, Trade and Industry (including a person who intends to install such pipelines). In this case, the term "heat supply facilities" in Article 20 and the phrase "pipelines to be used for the heat supply business" in Article 21, paragraph (1) shall be deemed to be replaced with "pipelines prescribed in Article 24 to be installed at places specified by an Ordinance of the Ministry of Economy, Trade and Industry under the said Article," the phrase "the items of the next paragraph" in Article 21, paragraph (4) shall be deemed to be replaced with "item (ii) of the next paragraph," and the phrase "the following items" in Article 21, paragraph (5) shall be deemed to be replaced with "item (ii)."
第五章 雑則
Chapter V Miscellaneous Provision
（許可等の条件）
(Conditions Attached to License, etc.)
第二十五条 許可又は認可には、条件を附し、及びこれを変更することができる。
Article 25 (1) Conditions may be attached to a license/permission or approval, and such conditions may be changed.
２ 前項の条件は、許可又は認可に係る事項の確実な実施を図るため必要な最小限度のものに限り、かつ、当該許可又は認可を受ける者に不当な義務を課することとなるものであつてはならない。
(2) The conditions set forth in the preceding paragraph shall be limited to the minimum required for ensuring successful implementation of the matters concerning the license/permission or approval, and shall not impose any unreasonable obligation on the person who is to obtain the license/permission or approval.

（報告の徴収）
(Request for Reports)
第二十七条 経済産業大臣は、この法律の施行に必要な限度において、政令で定めるところにより、熱供給事業者に対しその業務に関し、第二十四条に規定する者に対し同条の経済産業省令で定める場所に設置される同条に規定する導管の保安に関し、それぞれ報告をさせることができる。
Article 27 The Minister of Economy, Trade and Industry may, to the extent necessary for the enforcement of this Act, pursuant to the provision of a Cabinet Order, have a heat supply operator report on the services, and have a person prescribed in Article 24 report on the safety measures for the pipelines prescribed in the said Article to be installed at places specified by an Ordinance of the Ministry of Economy, Trade and Industry under the said Article, respectively.
（立入検査）
(On-site Inspection)
第二十八条 経済産業大臣は、この法律の施行に必要な限度において、その職員に熱供給事業者又は第二十四条に規定する者の営業所、事務所その他の事業場に立ち入り、熱供給施設、帳簿、書類その他の物件を検査させることができる。
Article 28 (1) The Minister of Economy, Trade and Industry may, to the extent necessary for the enforcement of this Act, cause officials of the Ministry of Economy, Trade and Industry to enter the business office or other office or other workplace of a heat supply operator or a person prescribed in Article 24, and inspect heat supply facilities, books, documents, and any other articles of the heat supply operator or the said person.
２ 前項の規定により立入検査をする職員は、その身分を示す証明書を携帯し、関係人に提示しなければならない。
(2) The officials who conduct an on-site inspection pursuant to the preceding paragraph shall carry a certificate of identification and show it to any person concerned.
３ 第一項の規定による立入検査の権限は、犯罪捜査のために認められたものと解釈してはならない。
(3) The authority under paragraph (1) shall not be construed as being vested for criminal investigation.
（聴聞の方法の特例）
(Special Provision for the Method for Hearing)
第二十九条 第十二条第一項から第三項までの規定による処分に係る聴聞の期日における審理は、公開により行わなければならない。
Article 29 (1) Proceedings on the date of a hearing with respect to a disposition under Article 12, paragraphs (1) to (3) shall be open to the public.
２ 前項の聴聞の主宰者は、行政手続法 （平成五年法律第八十八号）第十七条第一項 の規定により当該処分に係る利害関係人が当該聴聞に関する手続に参加することを求めたときは、これを許可しなければならない。
(2) The person chairing the hearing set forth in the preceding paragraph shall, upon request of any person interested in the disposition under Article 17, paragraph (1) of the Administrative Procedure Act (Act No. 88 of 1993), permit such a person to participate in the proceedings for the hearing.
（不服申立ての手続における意見の聴取）
(Hearing of Opinions in Appeal Procedure)
第三十条 この法律の規定による処分についての審査請求又は異議申立てに対する裁決又は決定は、その処分に係る者に対し、相当な期間をおいて予告をした上、公開による意見の聴取をした後にしなければならない。
Article 30 (1) An award or decision on a request for review or an objection with respect to a disposition made pursuant to this Act shall be made after giving advance notice of a reasonable period to the person concerning the disposition and after holding a public hearing.
２ 前項の予告においては、期日、場所及び事案の内容を示さなければならない。
(2) The advance notice set forth in the preceding paragraph shall specify the date and place of the hearing and the content of the case concerned.
３ 第一項の意見の聴取に際しては、その処分に係る者及び利害関係人に対し、その事案について証拠を提示し、意見を述べる機会を与えなければならない。
(3) When holding a public hearing as set forth in paragraph (1), the person concerning the disposition and any interested persons shall be given the opportunity to present evidence and state their opinions.
（苦情の申出）
(Filing of Complaints)
第三十一条 熱供給事業者の熱供給に関し苦情のある者は、経済産業大臣に対し、理由を記載した文書を提出して苦情の申出をすることができる。
Article 31 (1) Any person who has complaints about the heat supply from a heat supply operator may file such complaints to the Minister of Economy, Trade and Industry, with a written explanation of the reasons attached thereto.
２ 経済産業大臣は、前項の申出があつたときは、これを誠実に処理し、処理の結果を申出者に通知しなければならない。
(2) The Minister of Economy, Trade and Industry shall, when having received the complaints under the preceding paragraph, handle them in good faith and notify the complainant of the results of the handling.
（経過措置）
(Transitional Measures)
第三十二条 この法律の規定に基づき命令を制定し、又は改廃する場合においては、その命令で、その制定又は改廃に伴い合理的に必要と判断される範囲内において、所要の経過措置（罰則に関する経過措置を含む。）を定めることができる。
Article 32 When enacting, revising or abolishing an order pursuant to this Act, necessary transitional measures (including transitional measures concerning penal provisions) may be provided for by that order to the extent considered reasonably necessary for the enactment, revision or abolition.
（都道府県が処理する事務）
(Affairs Administered by Prefectural Governments)
第三十三条 この法律に規定する経済産業大臣の権限に属する事務の一部は、政令で定めるところにより、都道府県知事が行うこととすることができる。
Article 33 Part of the affairs within the authority of the Minister of Economy, Trade and Industry prescribed in this Act may be administered by prefectural governors pursuant to the provision of a Cabinet Order.
（権限の委任）
(Delegation of Authority)
第三十三条の二 この法律の規定により経済産業大臣の権限に属する事項は、政令で定めるところにより、経済産業局長又は産業保安監督部長に委任することができる。
Article 33-2 The authority of the Minister of Economy, Trade and Industry under this Act may be delegated to the Director of a Regional Bureau of Economy, Trade and Industry or the Director of a Regional Industrial Safety and Inspection Department pursuant to the provision of a Cabinet Order.
第六章 罰則
Chapter VI Penal Provisions
第三十四条 熱供給施設を損壊し、その他熱供給施設の機能に障害を与えて熱供給を妨害した者は、五年以下の懲役又は百万円以下の罰金に処する。
Article 34 (1) A person who has damaged heat supply facilities or caused interference with the functioning of heat supply facilities, thereby obstructing heat supply, shall be punished by imprisonment with work for not more than five years or a fine of not more than one million yen.
２ みだりに熱供給施設を操作して熱供給を妨害した者は、二年以下の懲役又は五十万円以下の罰金に処する。
(2) A person who has, without due cause, operated heat supply facilities, thereby obstructing heat supply, shall be punished by imprisonment with work for not more than two years or a fine of not more than 500,000 yen.
３ 熱供給事業に従事する者が正当な理由がないのに熱供給施設の維持又は運行の業務を取り扱わず、熱供給に障害を生ぜしめたときも、前項と同様とする。
(3) The same punishment shall be imposed if a person engaged in a heat supply business has not performed, without justifiable grounds, the services to maintain or operate heat supply facilities, thereby causing interference with heat supply.
４ 第一項及び第二項の未遂罪は、罰する。
(4) Attempt of the offenses prescribed in paragraph (1) and paragraph (2) shall be punished.
第三十五条 第三条の規定に違反して熱供給事業を営んだ者は、三年以下の懲役若しくは三百万円以下の罰金に処し、又はこれを併科する。
Article 35 A person who has, in violation of Article 3, conducted heat supply business shall be punished by imprisonment with work for not more than three years or a fine of not more than three million yen, or both.
第三十六条 次の各号の一に該当する者は、二年以下の懲役若しくは三百万円以下の罰金に処し、又はこれを併科する。
Article 36 A person who falls under any of the following items shall be punished by imprisonment with work for not more than two years or a fine of not more than three million yen, or both.
一 第十一条第一項の規定に違反して熱供給事業の全部又は一部を休止し、又は廃止した者
(i) A person who has, in violation of Article 11, paragraph (1), suspended or abolished the whole or a part of the heat supply business.
二 第十三条第一項の規定に違反して熱供給を拒んだ者
(ii) A person who has, in violation of Article 13, paragraph (1), refused to supply heat.
三 第十三条第二項の規定に違反して熱供給を行つた者
(iii) A person who has, in violation of Article 13, paragraph (2), supplied heat.
第三十七条 次の各号の一に該当する者は、三百万円以下の罰金に処する。
Article 37 A person who falls under any of the following items shall be punished by a fine of not more than three million yen.
一 第七条第一項の規定に違反して熱供給施設を変更した者
(i) A person who has, in violation of Article 7, paragraph (1), renovated heat supply facilities.
二 第十五条第一項の規定に違反して熱供給を行つた者
(ii) A person who has, in violation of Article 15, paragraph (1), supplied heat.
三 第十八条の規定による命令に違反した者
(iii) A person who has violated an order issued under Article 18.
第三十八条 次の各号の一に該当する者は、百万円以下の罰金に処する。
Article 38 A person who falls under any of the following items shall be punished by a fine of not more than one million yen.
一 第二十条第二項（第二十四条において準用する場合を含む。）の規定による命令に違反した者
(i) A person who has violated an order issued under Article 20, paragraph (2) (including the cases where it is applied mutatis mutandis pursuant to Article 24).
二 第二十一条第五項（第二十四条において準用する場合を含む。）の規定による命令に違反して導管の設置又は変更の工事をした者
(ii) A person who has, in violation of an order issued under Article 21, paragraph (5) (including the cases where it is applied mutatis mutandis pursuant to Article 24), implemented a construction project to install or renovate pipelines.
第三十九条 次の各号の一に該当する者は、三十万円以下の罰金に処する。
Article 39 A person who falls under any of the following items shall be punished by a fine of not more than 300,000 yen.
一 第六条第四項（第七条第四項において準用する場合を含む。）、第十条第二項又は第二十三条第一項若しくは第二項の規定による届出をせず、又は虚偽の届出をした者
(i) A person who has failed to give notice under Article 6, paragraph (4) (including the cases where it is applied mutatis mutandis pursuant to Article 7, paragraph (4)), Article 10, paragraph (2) or Article 23, paragraph (1) or paragraph (2), or has given a false notice.
二 第十七条又は第二十二条第一項の規定による記録をせず、又は虚偽の記録をした者
(ii) A person who has failed to make records under Article 17 or Article 22, paragraph (1), or has made false records.
三 第二十一条第一項（同条第二項又は第二十四条において準用する場合を含む。）又は第三項（第二十四条において準用する場合を含む。）の規定に違反して導管の設置又は変更の工事をした者
(iii) A person who has, in violation of Article 21, paragraph (1) (including the cases where it is applied mutatis mutandis pursuant to paragraph (2) of the said Article or Article 24) or paragraph (3) (including the cases where it is applied mutatis mutandis pursuant to Article 24), implemented a construction project to install or modify pipelines.
四 第二十三条第三項の規定による命令に違反した者
(iv) A person who has violated an order issued under Article 23, paragraph (3).
五 第二十七条の規定による報告をせず、又は虚偽の報告をした者
(v) A person who has failed to submit reports under Article 27, or has submitted false reports.
六 第二十八条第一項の規定による検査を拒み、妨げ、又は忌避した者
(vi) A person who has refused, obstructed or avoided an inspection under Article 28, paragraph (1).
第四十条 法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務に関し、第三十五条から前条までの違反行為をしたときは、行為者を罰するほか、その法人又は人に対して、各本条の罰金刑を科する。
Article 40 Where the representative of a juridical person or an agent, employee or other worker of a juridical person or an individual has, with regard to the business of the juridical person or individual, committed the violations of Article 35 to the preceding Article, not only shall the offender be punished but also the juridical person or the individual shall be punished by the fine prescribed in the respective Articles.
第四十一条 第七条第二項又は第八条の規定による届出をせず、又は虚偽の届出をした者は、二十万円以下の過料に処する。
Article 41 A person who has failed to give a notice under Article 7, paragraph (2) or Article 8, or has given a false notice shall be punished by a civil fine of not more than 200,000 yen.
