Part I
Preliminary
1.Citation

(1)These regulations may be cited as the Electricity (Registration) Regulations.

2.Interpretation
In these regulations—
technical institute (工業學院) has the same meaning as in section 2 of the Vocational Training Council Ordinance (Cap. 1130).

Part II
Registration of Contractors
3.Registration of contractors
To be qualified as a registered electrical contractor the applicant for registration must either employ at least one registered electrical worker or— (E.R. 1 of 2021)
(a)if the applicant is an individual, he must be a registered electrical worker; or
(b)if the applicant is a partnership, one of the partners must be a registered electrical worker.

Part III
Grades of Electrical Work and Qualifications of Workers
4.Grade A electrical work
(1)Grade A electrical work is electrical work on that part of a low voltage fixed electrical installation that has a maximum demand not exceeding 400 A, single or three phase.
(2)An individual is qualified to be registered for Grade A electrical work if he satisfies the Director—
(a)that he—
(i)has completed a registered contract of apprenticeship under the Apprenticeship Ordinance (Cap. 47) in the trade of electrical fitter or electrician;
(ii)holds a craft certificate in electrical engineering issued by a technical institute; and
(iii)has at least 1 year of practical experience in electrical work;
(b)that he has been employed as an electrical worker for at least 5 years at least 1 year of which included practical experience in electrical work and he—
(i)holds a Certificate of the Electrician or Electrical Fitter Upgrading Course issued by the Electrical Industry Training Centre of the Vocational Training Council or has an equivalent qualification; or
(ii)has passed an examination or trade test approved or set by the Director;
(c)that he has been employed as an electrical worker for at least 6 years at least 1 year of which included practical experience in electrical work; or
(d)that his qualifications and experience are equivalent to those required under paragraph (a), (b) or (c).
(3)In order for an applicant to qualify for registration under subregulation (2)(c), or to qualify for registration under subregulation (2)(d) on the basis of equivalence to subregulation (2)(c), his application for registration must be received by the Director on or before a date to be fixed by the Director and published in the Gazette.
5.Grade B electrical work
(1)Grade B electrical work is electrical work on that part of a low voltage fixed electrical installation that has a maximum demand not exceeding 2 500 A, single or three phase.
(2)An individual is qualified to be registered for Grade B electrical work if he satisfies the Director—
(a)that he—
(i)has completed a registered contract of apprenticeship under the Apprenticeship Ordinance (Cap. 47) in the trade of electrical fitter, electrician or electrical engineering technician;
(ii)holds a Higher Certificate in Electrical Engineering issued by the Hong Kong Polytechnic or The Hong Kong Polytechnic University or has an equivalent qualification; and (L.N. 638 of 1994)
(iii)has at least 2 years of practical experience in electrical work;
(b)that he—
(i)holds a Diploma in Electrical Engineering issued by a technical institute or has an equivalent qualification; and
(ii)has been employed as an electrical worker for at least 5 years at least 2 years of which included practical experience in electrical work;
(c)that he has held, or was qualified to hold, a Grade A certificate for at least 5 years and he—
(i)holds a Certificate in Electrical Engineering issued by a technical institute or has an equivalent qualification and has at least 3 years of practical experience in electrical work; or
(ii)has at least 5 years of practical experience in electrical work and has passed an examination or trade test approved or set by the Director; or
(d)that his qualifications and experience are equivalent to those required under paragraph (a), (b) or (c).
6.Grade C electrical work
(1)Grade C electrical work is electrical work on a low voltage fixed electrical installation of any capacity.
(2)An individual is qualified to be registered for Grade C electrical work if he satisfies the Director—
(a)that he has obtained a degree in electrical engineering in a recognized university or an institution of tertiary education or has an equivalent qualification and he—
(i)has completed at least 2 years of post-graduate training in electrical engineering recognized by the Director and has at least 2 years of subsequent practical experience in electrical work; or
(ii)has at least 6 years of post-graduate practical experience in electrical engineering including at least 1 year of practical experience in electrical work;
(b)that he—
(i)has held, or was qualified to hold, a Grade B certificate for at least 6 years;
(ii)has at least 6 years of practical experience in electrical work; and
(iii)has passed an examination or trade test approved or set by the Director; or
(c)that his qualifications and experience are equivalent to those required under paragraph (a) or (b).
7.Grade H electrical work
(1)Grade H electrical work is electrical work on a high voltage electrical installation.
(2)An individual is qualified to hold a Grade H certificate if he satisfies the Director that he is qualified to hold a Grade B or Grade C certificate and that he—
(a)has completed a training course approved by the Director for the design, installation, maintenance, testing or operation of high voltage electrical equipment and installations; or
(b)has at least 1 year of practical experience in the design, installation, maintenance, testing or operation of high voltage electrical equipment and installations.
8.Grade R electrical work
(1)Grade R electrical work may include one or more of the following—
(a)electrical work on a neon sign installation;
(b)electrical work on an air-conditioning installation;
(c)electrical work on a generating facility installation; and
(d)any other type of electrical work, or work on any type of electrical installation or premises, that the Director, under section 30(3), specifies on a registered electrical worker’s certificate of registration.
(2)An individual is qualified to be registered for Grade R electrical work if he satisfies the Director that he has special training and has at least 4 years of experience in the type, or similar type, of electrical work for which he is seeking a Grade R certificate.

Part IV
Application, Registration, Term, Renewal
9.Application for registration
An applicant for registration as an electrical contractor or electrical worker shall submit to the Director—
(a)an application in a form required by the Director;
(b)documents that the Director considers are relevant to the applicant’s registration or qualifications for registration; and
(c)the application fee specified in the Schedule.
10.Register
(1)The Director shall maintain a register of registered electrical contractors and a register of registered electrical workers.
(2)The Director shall delete a registration from a register where the registration is cancelled under the Ordinance.
(3)The Director shall amend the register to indicate a period of suspension of registration under the Ordinance.
(4)The Director may delete a registration from a register—
(a)where the registrant requests that his registration be cancelled; or
(b)where the Director, after reasonable effort, has been unable to confirm that the registrant—
(i)if a worker, is still alive; or
(ii)if a contractor, is still carrying on business as an electrical contractor.
(5)The Director shall restore to the register a registration deleted under subregulation (4)(b) where he considers that the deletion was made in error.
11.Certificate of registration
(1)On registration the Director shall issue a certificate of registration to the registrant.
(2)On payment of the fee specified in the Schedule, the Director—
(a)shall issue to a contractor registrant a copy of his certificate of registration for each of his business addresses as required by section 34(8); and
(b)may issue to a registrant a replacement copy of his certificate of registration.
12.Period of registration
A registration or renewed registration shall be valid for the 3-year period shown on the certificate.

13.Renewal of registration
(1)A registered electrical contractor or a registered electrical worker who wishes to renew his registration shall submit to the Director an application for renewal of registration in a form required by him.
(2)The applicant shall submit with the application form—
(a)documents that the Director considers are relevant to the applicant’s registration or qualifications for renewal of registration; and
(b)the renewal fee specified in the Schedule.
(3)The application must be submitted to the Director at least 1 month before, and no earlier than 4 months before, the expiry date of the current registration.
(4)Where a registrant has had his right to apply for renewal of registration suspended for a specified period of time he must submit his application for renewal no later than 1 month after the end of the specified period.
(5)The Director need not consider an application for renewal that is submitted before or after the times allowed under subregulation (3) or (4) but an application submitted before the allowed time under subregulation (3) may be resubmitted within the allowed time and a person who has not submitted an application for renewal by the time allowed under subregulation (3) or (4) may submit a fresh application under regulation 9.
13A.Concessions on certain fees payable under Part IV
(1)Despite regulation 9(c)—
(a)for an application for registration as an electrical contractor received during the concession period—the application fee is $570 instead of the fee specified in the Schedule; and
(b)for an application for registration as an electrical worker received during the concession period—the application fee is $315 instead of the fee specified in the Schedule.
(2)Despite regulation 13(2)(b)—
(a)for an application for renewal of registration as an electrical contractor received during the concession period—the renewal fee is $570 instead of the fee specified in the Schedule; and
(b)for an application for renewal of registration as an electrical worker received during the concession period—the renewal fee is $315 instead of the fee specified in the Schedule.
(3)In this regulation—
concession period (寬免期) means the period from 1 October 2021 to 30 September 2022 (both dates inclusive). (L.N. 195 of 2021)

Part V
Generating Facility Registration
14.Application for generating facility registration
An owner who applies to register a generating facility shall submit to the Director—
(a)an application in a form required by the Director;
(b)documents that the Director considers are relevant to the applicant’s registration; and
(c)the application fee specified in the Schedule.
15.Register of generating facilities
(1)The Director shall maintain a register of registered generating facilities and their owners.
(2)The Director shall delete a registration from the register where the registration is cancelled under the Ordinance.
(3)The Director shall delete a registration from the register where he is satisfied that the generating facility is no longer required to be registered under the Ordinance.
16.Certificate of generating facility registration
(1)On registration the Director shall issue to the owner a certificate of generating facility registration.
(2)On payment of the fee specified in the Schedule, the Director may issue a replacement copy of the certificate of generating facility registration to the owner of a registered generating facility.
17.Change of particulars
(1)Where any of the particulars provided on the form referred to in regulation 14 change, the owner shall notify the Director within 4 weeks after the change.
(2)An owner who contravenes subregulation (1) commits an offence and is liable to a fine at level 3. (E.R. 1 of 2021)

Part VI
Transitional
18.Transitional registration periods
(1)During the first—
(a)18 months after commencement* of section 30; and
(b)6 months after commencement# of section 33,
the Director may, after the date of commencement+ of sections 31 and 34 and notwithstanding regulation 12, extend the period of validity of the registration of—
(i)a worker for up to 4 1/2 years after the commencement of section 31; and
(ii)a contractor for up to 3 1/2 years after the commencement of section 34.
(2)Notwithstanding regulation 11(1), the Director may defer the issue of a certificate of registration for a worker or contractor referred to in subregulation (1) until the Governor appoints a day for the commencement of sections 31 and 34.
