Part I
Preliminary

2.Interpretation
(1)In this Regulation, unless the context otherwise requires—
accreditation (審定) means formal recognition by an accreditation body or obtained under HOKLAS that an organization is competent to carry out a test or specific types of tests of electrical products under the category of electrical and electronic products;
accreditation body (審定團體) means a body which conducts and administers an accreditation system and grants accreditation and has entered into a mutual recognition agreement with the HOKLAS Executive or the HKAS Executive; (L.N. 77 of 2000)
adaptor (適配接頭) means any device which may be engaged with a socket and that is designed—
(a)to enable a plug having pins, or other forms of contact, of different dimensions or configuration from those of the socket, to be engaged with the socket;
(b)to enable more than one plug to be engaged with the socket; or
(c)to be used for both of the purposes mentioned in paragraphs (a) and (b);
appliance coupler (器具聯接器) means a device designed to connect a flexible cable or cord to an electrical product and consisting of—
(a)a connector which is an integral part of, or intended to be attached to, the flexible cable or cord; and
(b)an inlet which is incorporated into or fixed to the electrical product or intended to be fixed to it;
applicable safety requirements (適用的安全規格), in relation to an electrical product, means the requirements that apply to that electrical product by virtue of sections 4, 5 and 6; (L.N. 77 of 2000)
braid (滾帶) has the same meaning as in IEC 50;
BS when followed by a number, or a combination of letters and numbers, means the British Standard Specification of that number, or that combination of letters and numbers published by the British Standards Institution;
cable connector (電纜接頭) means a device designed to join flexible cables or cords in such a way that the cables or cords can be joined and separated without the use of a tool;
CB Scheme (CB體系) means the scheme operated by the IECEE for recognition of results of testing to standards for safety of electrical equipment;
CB Test Certificate (CB測試證明書) means a document attesting that a sample of an electrical product has been tested and found to be in conformity with the standard accepted for use in the CB Scheme and according to which the product has been tested;
certificate (證明書) means a document certifying the test results of an electrical product;
certificate of safety compliance (符合安全規格證明書) means a certificate issued under Part III;
certification body (核證團體) means a body that conducts certification of safety of electrical products;
circuit (電路) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
circuit protective conductor (電路保護導體) means a protective conductor connecting exposed conductive parts of an equipment to the main earthing terminal;
class I product (第I類產品) has the same meaning as “class I appliance” in IEC 335 Part 1;
class II product (第II類產品) has the same meaning as “class II appliance” in IEC 335 Part 1;
conductor (導體) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
declaration of conformity (符合標準聲明) means a statement issued by a manufacturer of electrical products claiming under his sole responsibility that a product manufactured by him is in conformity with a standard;
earth (地) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
earth fault current (電路的接地故障電流) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
earthing (接地) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
EN when followed by a number, or a combination of letters and numbers means the European Standard of that number or that combination of letters and numbers published by the European Committee for Electrotechnical Standardisation;
exposed conductive part (外露非帶電金屬部分) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
extension unit (拖板) means a device designed to connect a mains socket to a number of electrical products and consisting of—
(a)a plug which is intended to be connected to the mains socket;
(b)a combination of one or more sockets in which a plug or plugs of electrical products may be inserted; and
(c)a flexible cord connecting the plug in paragraph (a) and the socket or sockets in paragraph (b);
flexible cable (軟電纜) has the same meaning as in IEC 50;
flexible cord (軟電線) has the same meaning as “cord” in IEC 50;
fuse (熔斷器) has the same meaning as in IEC 291;
fuse-link (熔斷連桿) has the same meaning as in IEC 291;
hand-held product (手提產品) has the same meaning as “hand-held appliance” in IEC 335 Part 1;
HKAS (香港認可處) has the same meaning as in Regulations for Laboratory Accreditation (HOKLAS 002) of the Hong Kong Laboratory Accreditation Scheme as amended from time to time; (L.N. 77 of 2000)
HKAS Executive (香港認可處的執行人員) has the same meaning as in Regulations for Laboratory Accreditation (HOKLAS 002) of the Hong Kong Laboratory Accreditation Scheme as amended from time to time; (L.N. 77 of 2000)
HOKLAS (香港實驗所認可計劃) has the same meaning and objectives as in Regulations for Laboratory Accreditation (HOKLAS 002) of the Hong Kong Laboratory Accreditation Scheme as amended from time to time; (L.N. 77 of 2000)
HOKLAS Executive (香港實驗所認可計劃的執行人員) has the same meaning as in Regulations for Laboratory Accreditation (HOKLAS 002 Fourth Edition) of the Hong Kong Laboratory Accreditation Scheme under the charge of the Director-General of Industry on behalf of the Government;
IEC means the International Electrotechnical Commission and when followed by a number, or a combination of letters and numbers, means the International Standard publication bearing that number or that combination of letters and numbers published by the International Electrotechnical Commission;
IECEE (國際電工委員會電工產品安全認證組織) means the IEC System for Conformity Testing to Standards for Safety of Electrical Equipment;
ISO means the International Organization for Standardization and when followed by a number, or a combination of letters and numbers means the International Standard publication bearing that number or that combination of letters and numbers published by the International Organization for Standardization;
luminaire (照明器) has the same meaning as in IEC 598 Part 1;
main earthing terminal (總接地終端) has the same meaning as in regulation 2 of the Electricity (Wiring) Regulations (Cap. 406 sub. leg. E); (E.R. 3 of 2021)
National Certification Body (國家核證團體) means a body which operates a national certification or approval scheme for electrical products under the CB Scheme;
plug (插頭) means a device, other than a cable connector or an appliance coupler, which may be engaged with a socket and which is designed for the purpose of connecting to a socket any electrical product to which the device is attached by means of a flexible cable or cord;
prescribed product (訂明產品) means an electrical product specified in column 2 of Schedule 2;
product (產品) means an electrical product;
rated current (額定電流值) means the current assigned to the product by the manufacturer;
rated frequency (額定頻率) means the frequency assigned to the product by the manufacturer;
rated voltage (額定電壓) means the voltage assigned to the product by the manufacturer;
recognized certification body (認可核證團體) means a body recognized by the Director as qualified to issue certificates of safety compliance in respect of electrical products;
recognized manufacturer (認可製造商) means a manufacturer of electrical products recognized by the Director as qualified to issue certificates of safety compliance in respect of electrical products manufactured by that manufacturer;
safety shutter (安全活門) has the same meaning as “shutter” in BS 1363 Part 2;
socket (插座) means a device, other than a cable connector, with which a plug may be engaged for the purpose of connecting to a circuit, whether or not by means of a switch, an electrical product to which the plug is attached;
standard (標準) means—
(a)the British Standard published by the British Standards Institution;
(b)the European Standard published by the European Committee for Electrotechnical Standardisation;
(c)the International Standard published by the International Electrotechnical Commission or the International Organization for Standardization; or
(d)any other standards,
as may be accepted by the Director;
supplier (供應商) means a person who supplies an electrical product;
test report (測試報告) means a document that presents test results of an electrical product which has been tested to a standard;
thermal cut-out (過熱斷路器) has the same meaning as in IEC 335 Part 1;
thermostat (恆溫器) has the same meaning as in IEC 335 Part 1;
tinsel conductor (箔導體) has the same meaning as in IEC 50;
tool (工具) has the same meaning as in IEC 335 Part 1;
travel adaptor (旅行適配接頭) means an adaptor which is not designed to engage with a mains socket in Hong Kong but enables a plug to be connected to a mains socket of places outside Hong Kong.

(2)In this Regulation—
(a)in the case of a standard being referred to in this Regulation, the reference is a reference to the standard effective as at the date of enactment of this Regulation; and
(b)in the case of a standard referred to in this Regulation that specifies a requirement by reference to another standard, then that reference is to be construed as a reference to that other standard effective as at the date of enactment of this Regulation.
3.Application to electrical products
(1)This Regulation applies to an electrical product which is—
(a)designed for household use; and
(b)supplied in Hong Kong.
(2)This Regulation does not apply to an electrical product which is—
(a)under transhipment or in transit through Hong Kong;
(b)manufactured in Hong Kong for export;
(c)supplied for reconditioning;
(d)supplied as scrap;
(e)a travel adaptor; or
(f)supplied in a place other than Hong Kong under a sale agreement entered into in Hong Kong.
(3)This Regulation does not apply to an electrical product which is supplied as part of or in connection with a disposition of any premises unless the disposition is the first disposition made prior to the first occupation of the premises. (L.N. 77 of 2000)
(4)In this section, disposition (處置) includes a sale, lease, licence and permission to occupy. (L.N. 77 of 2000)

Part II
Safety Requirements
4.Essential safety requirements for electrical products
All electrical products shall comply with the essential safety requirements for electrical products specified in Schedule 1.
5.Specific safety requirements for prescribed products
All prescribed products specified in column 2 of Schedule 2 shall comply with the specific safety requirements specified in column 3 of that Schedule opposite thereto in addition to the essential safety requirements for electrical products specified in Schedule 1.
6.Applicable safety requirements for particular types of electrical products
(1)Subject to subsection (2), all electrical products shall be class I or class II products.
(2)The electrical products referred to in subsection (1) do not include accessories and lighting fittings which do not receive power supply from a mains socket.
(3)Subject to subsection (4), no person shall supply an electrical product which is designed—
(a)to operate at a voltage of not less than 200V alternating current single phase;
(b)to operate at a maximum rated current of not more than 15A; and
(c)to be connected by means of a flexible cord and plug to a socket and is designed to be so connected directly without the use of a cable connector,
unless the product is fitted with a plug of the correct rating which complies with the applicable safety requirements. (L.N. 77 of 2000)
(4)Subsection (3) does not apply to an electrical product which—
(a)is fitted with a plug of the correct rating and conforms to IEC 884-1: Plugs and Socket Outlets for Household and Similar Purposes (IEC 884-1 plug); and
(b)is fitted with an adaptor which—
(i)when connected to a mains socket in Hong Kong, provides a safety level equivalent to that of plugs that conform to the applicable safety requirements; (L.N. 77 of 2000)
(ii)encloses the plug; and
(iii)can be removed only with the use of a tool.
(5)For a class I product, the equivalent safety level in subsection (4) requires that the IEC 884-1 plug to be fitted to the electrical product shall have a contact so that, when fitted to an adaptor referred to in that subsection, a path for any earth fault current flowing from the exposed conductive parts of the electrical product to the circuit protective conductors of the fixed electrical installation will be maintained.
(6)For an electrical product which is designed to receive power supply from a mains socket without connecting through a flexible cord, the construction and dimensions of the plug pins shall conform to BS 546 or BS 1363 Part 1.
(7)For an electrical product which is designed to receive power from a shaver supply unit conforming to BS 3535 Part 1 without connecting through a flexible cord, the construction and dimensions of the plug pins shall conform to BS 4573 or EN 50075.
(8)An electrical product which is designed solely for use at a voltage of less than 200V alternating current single phase shall carry a warning label as specified in Schedule 3.

Part III
Certificate of Safety Compliance
7.Certificate of safety compliance
(1)No person shall supply an electrical product unless a certificate of safety compliance has been issued in respect of the product and the product complies with the applicable safety requirements. (L.N. 77 of 2000)
(2)Subject to subsection (3), a certificate of safety compliance shall include the following information in the English or Chinese language—
(a)a reference number;
(b)the name and model or type reference of the electrical product;
(c)the name and address of the manufacturer;
(d)the name and address of the person who requested testing of the electrical product;
(e)a standard to which the electrical product was tested and found in conformity;
(f)the name, address, authorized signature and, if applicable, company seal of the recognized certification body or recognized manufacturer, as the case may be; and
(g)the date of certification.
(3)If the information in a certificate of safety compliance is not in the English or Chinese language, the certificate of safety compliance shall be accompanied by a translation of the information in English or Chinese.
8.Issue of certificate of safety compliance
(1)Subject to subsection (2), no document shall be accepted by the Director as a certificate of safety compliance unless it is—
(a)a CB Test Certificate issued by a National Certification Body under the CB Scheme which is also a recognized certification body;
(b)a certificate or test report issued by an organization which has been authorized by HOKLAS to endorse the certificate or test report in the name of HOKLAS and is also a recognized certification body;
(c)a certificate or test report issued by an organization which has been authorized by an accreditation body to endorse the certificate or test report in the name of that accreditation body and is also a recognized certification body;
(d)a declaration of conformity issued by a recognized manufacturer; or
(e)a certificate or test report which, in the opinion of the Director, demonstrates that an electrical product complies with the applicable safety requirements. (L.N. 77 of 2000)
(2)A declaration of conformity issued by a manufacturer of a product not specified in column 2 of Schedule 2 may be accepted by the Director as a certificate of safety compliance where the information contained in the declaration of conformity is the same as the information required under section 7(2) other than paragraphs (a) and (d) of that subsection.
(3)The Director may—
(a)refuse to accept a certificate of safety compliance which has been issued in respect of an electrical product which does not comply with the applicable safety requirements; and
(b)publish in the Gazette the name of the manufacturer and the details of the electrical product referred to in paragraph (a).

Part IV
Recognized Certification Bodies and Recognized Manufacturers
9.Recognized certification bodies
(1)Where the Director considers that a certification body possesses the capabilities and resources to test and certify the safety aspects of a specified class of electrical products, the Director may recognize the certification body as a recognized certification body qualified to issue certificates of safety compliance in respect of that specified class of electrical products.
(2)A certification body applying for recognition by the Director as a recognized certification body shall be one of the organizations specified in Schedule 4 and shall—
(a)apply in writing to the Director for recognition as a recognized certification body; and
(b)pay an application fee of $5,950. (L.N. 353 of 2000)
(3)The Director may publish in the Gazette—
(a)the name of a certification body that he has recognized as a recognized certification body; and
(b)the specified class of electrical products which may be certified by that recognized certification body.
(4)The Director may maintain a register of recognized certification bodies for inspection by the public during normal office hours.
(5)Subject to subsection (6), the Director may revoke the recognition of any recognized certification body for all or some of the specified classes of electrical products for which the recognized certification body has been recognized by the Director—
(a)where a recognized certification body requests cancellation of its recognition;
(b)where a recognized certification body ceases to carry on business as a certification body; or
(c)where the Director considers that a recognized certification body is no longer qualified to issue certificates of safety compliance in respect of a specified class of electrical products,
and may publish in the Gazette the name of such certification body and the details of the specified classes of electrical products which that recognized certification body is no longer qualified to issue certificates of safety compliance.
(6)The Director shall notify the recognized certification body of his intended revocation in cases under subsection (5)(b) or (c)—
(a)specifying his grounds for intending to revoke the recognition; and
(b)advising the recognized certification body that it is entitled to request a hearing by the Director or to submit written representations to the Director as to why recognition should not be revoked.
(7)Within 4 weeks after the service of the notice under subsection (6), the recognized certification body shall either deliver a request in writing for a hearing or make written representations to the Director.
(8)If no request for a hearing or no written representations have been received within the period referred to in subsection (7), the Director may revoke the recognition of the certification body.
(9)Where the Director receives a request for a hearing within the period referred to in subsection (7), he shall afford the recognized certification body a reasonable opportunity to be heard.
(10)The Director may revoke the recognition of a certification body if the certification body fails to attend the hearing without a reasonable excuse.
(11)Where the Director receives written representations within the period referred to in subsection (7) or where representations are made at the hearing, the Director shall consider those representations before exercising any of his power under subsection (5).
(12)In cases where a written request for a hearing or written representations have been received within the period referred to in subsection (7), the Director shall notify the recognized certification body of his decision and the reasons for it.
(13)Upon revocation of recognition of a certification body, the Director shall cause the name of such certification body to be removed from the register maintained under subsection (4).
(14)A certification body whose name has been removed from the register under this section may apply in writing to the Director for restoration of its name to the register.
(15)The Director may restore the name of a certification body to the register if the Director satisfies himself that the certification body—
(a)is an organization specified in Schedule 4; and
(b)has taken appropriate steps to remedy the cause that originally led to the revocation.
10.Recognized manufacturers
(1)Where the Director considers that a manufacturer of an electrical product possesses the capabilities and resources to test and certify the safety aspects of an electrical product, the Director may recognize the manufacturer as a recognized manufacturer qualified to issue a certificate of safety compliance in respect of that electrical product manufactured by that manufacturer.
(2)A manufacturer applying for recognition by the Director as a recognized manufacturer shall comply with the requirements for recognition specified in Schedule 5 and shall—
(a)apply in writing to the Director for recognition as a recognized manufacturer; and
(b)pay an application fee of $5,950. (L.N. 353 of 2000)
(3)The Director may publish in the Gazette—
(a)the name of a manufacturer that he has accepted as a recognized manufacturer; and
(b)the electrical products which may be certified by that recognized manufacturer.
(4)The Director may maintain a register of recognized manufacturers for inspection by the public during normal office hours.
(5)Subject to subsection (6), the Director may revoke the recognition of any manufacturer of all or some of the electrical products for which the recognized manufacturer has been recognized by the Director—
(a)where a recognized manufacturer requests cancellation of his recognition;
(b)where a recognized manufacturer ceases to carry on business as a manufacturer; or
(c)where the Director considers that a recognized manufacturer is no longer qualified to issue certificates of safety compliance in respect of an electrical product manufactured by the manufacturer,
and may publish in the Gazette the name of such manufacturer and the details of the electrical product which that recognized manufacturer is no longer qualified to issue certificates of safety compliance.
(6)The Director shall notify the recognized manufacturer of his intended revocation in cases under subsection (5)(b) or (c)—
(a)specifying his grounds for intending to revoke the recognition; and
(b)advising the recognized manufacturer that he is entitled to request a hearing by the Director or to submit written representations to the Director as to why recognition should not be revoked.
(7)Within 4 weeks after the service of the notice under subsection (6), the recognized manufacturer shall either deliver a request in writing for a hearing or make written representations to the Director.
(8)If no request for a hearing or no written representations have been received within the period referred to in subsection (7), the Director may revoke the recognition of the manufacturer.
(9)Where the Director receives a request for a hearing within the period referred to in subsection (7), he shall afford the recognized manufacturer a reasonable opportunity to be heard.
(10)The Director may revoke the recognition of a manufacturer if the manufacturer fails to attend the hearing without a reasonable excuse.
(11)Where the Director receives written representations within the period referred to in subsection (7) or where representations are made at the hearing, the Director shall consider those representations before exercising any of his power under subsection (5).
(12)In cases where a written request for a hearing or written representations have been received within the period referred to in subsection (7), the Director shall notify the recognized manufacturer of his decision and the reasons for it.
(13)Upon revocation of recognition of a manufacturer, the Director shall cause the name of such manufacturer to be removed from the register maintained under subsection (4).
(14)A manufacturer whose name has been removed from the register under this section may apply in writing to the Director for restoration of his name to the register.
(15)The Director may restore the name of a manufacturer to the register if the Director satisfies himself that the manufacturer—
(a)meets the requirements specified in Schedule 5; and
(b)has taken appropriate steps to remedy the cause that originally led to the revocation.

Part V
Director’s Powers
11.Director’s powers
(1)Notwithstanding that a certificate of safety compliance has been issued, where in the opinion of the Director, an electrical product does not comply with the applicable safety requirements, the Director may serve a written notice on the supplier of the electrical product concerned— (L.N. 77 of 2000)
(a)requiring that supplier or that supplier’s agent to—
(i)notify the purchasers to whom the supplier or the supplier’s agent has supplied the electrical product of the hazardous defects in the product;
(ii)accept a return of the product; and
(iii)refund the purchasers any sum paid for the product subject to a condition that a receipt for the product is surrendered to that supplier or that supplier’s agent; and
(b)requiring that supplier or that supplier’s agent to make public any notification referred to in paragraph (a)(i) and to publicize the matters referred to in paragraph (a)(ii) and (iii) by—
(i)making announcements each lasting not less than 30 seconds, at least once on a week-day and once on a Sunday, on 4 television channels approved by the Director; and
(ii)placing advertisements of not less than 26 cm × 17 cm in size, at least once on a week-day and once on a Sunday, in 4 Chinese language newspapers and one English language newspaper in Hong Kong.
(2)The Director may specify in the notice issued under subsection (1) the type of information required in the announcements and advertisements.
(3)Notwithstanding subsections (1) and (2), the Director may order the supplier or the supplier’s agent of the electrical product concerned to use such other effective means to notify the purchasers of hazardous defects in the product as the Director considers reasonable.

Part VI
Offences and Penalties
12.Offences
A person who—
(a)supplies an electrical product which fails to comply with the applicable safety requirements; or
(b)fails or refuses to comply with a notice served by the Director under section 11(1),
commits an offence.

13.Penalties
A person who commits an offence under section 12 is liable—
(a)on first conviction, to a fine at level 6 and to imprisonment for 1 year; and
(b)on subsequent conviction, to a fine of $500,000 and to imprisonment for 2 years.
14.Defence of due diligence
(1)It is a defence in a proceeding against a person for an offence under section 12(a) if the person charged shows that he took all reasonable steps and exercised all due diligence to avoid committing the offence.
(2)Where in any proceedings the defence under subsection (1) involves an allegation that the commission of the offence was due—
(a)to the act or default of another person; or
(b)to reliance on information given by another,
the person charged is not, without the leave of the court, entitled to rely on the defence unless, not less than 7 clear working days before the hearing of the proceedings, he has served a notice on the person bringing the proceedings giving such information identifying or assisting in the identification of the person who committed the act or default or gave the information that was in the possession of the person serving the notice at the time he served it.
(3)A person is not entitled to rely on the defence under subsection (1) by reason of his reliance on information given by another person, unless he shows that it was reasonable in all the circumstances for him to have relied on the information, having regard in particular—
(a)to the steps which he took, and those which might reasonably have been taken, for the purpose of verifying the information; and
(b)to whether he had any reason to disbelieve the information.

Essential Safety Requirements for Electrical Products
1.General conditions
(1)The requirements in subsection (2), the recognition and observance of which will ensure that an electrical product will be used safely in applications for which it is made, shall be printed on the product in English, Chinese or international standard symbols, or, if this is not possible, on an accompanying notice.
(2)Such requirements shall include—
(a)rated voltage and frequency;
(b)rated input in terms of watts, kilowatts, amperes or milliamperes; (L.N. 77 of 2000)
(c)model or type reference number; and
(d)manufacturer’s name or trade mark.
(3)The electrical product, together with its component parts, shall be made in such a way as to ensure that it can be safely and properly assembled and connected.
2.Protection against hazards arising from an electrical product
An electrical product shall be so designed and constructed in order to ensure that—
(a)persons and animals are adequately protected against danger of physical injury or other harm which might be caused by electrical contact whether direct or indirect;
(b)temperatures, arcs or radiation which are not part of the intended function of the product, and likely to cause a danger, are not produced;
(c)persons, animals and property are adequately protected against non-electrical danger caused by the electrical product which are revealed by experience;
(d)persons and animals are adequately protected against danger due to hazardous materials used in the electrical product; and
(e)the insulation is suitable for foreseeable conditions.
3.Protection against hazards which may be caused by external influences on an electrical product
An electrical product shall be so designed and constructed in order to ensure that—
(a)the electrical product meets the expected mechanical requirements in such a way that persons, animals and property are adequately protected against danger caused by the electrical product;
(b)the electrical product is resistant to non-mechanical influences in expected environmental conditions, in such a way that persons, animals and property are adequately protected against danger caused by the electrical product;
(c)in foreseeable conditions of overload, persons, animals and property are adequately protected against danger caused by the electrical product; and
(d)the electrical product, other than a fixed and hand-held product, has such stability that it can be maintained in a specific position.

(4)The unvented thermal storage type electric water heater shall be fitted with the following— |
(a)a thermostat which shall be fitted to control the heating of the stored water; |
(b)a thermal cut-out which— | | | | | (i) | shall be fitted to cut off the supply of electricity when the stored water is heated above the temperature setting of the thermostat and before the operation of the temperature and pressure relief valve is initiated; |

(ii)shall be wired in series with the thermostat referred to in subparagraph (a); and |
(iii)shall require manual resetting when the enclosure of the electric water heater is dismantled; and |
(c)a temperature and pressure relief valve which— |
(i)shall be fitted with either— |
(A)a non-resettable temperature relief valve, having a set temperature of 90℃ and being provided with manual test mechanism; and | | | | | | (B) | a pressure relief valve, having a set pressure not greater than the maximum designed pressure of the electric water heater or than 1 000 kPa, and being provided with manual test mechanism; or |

(ii)a non-resettable temperature and pressure relief valve, having a set temperature of 90℃ and a set pressure not greater than the maximum designed pressure of the water heater or than 1 000 kPa, and being provided with manual test mechanism.___________

Warning Label for Electrical Products Designed Solely for Use at a Voltage of Less than 200V Alternating Current Single Phase
The warning label—
(a)shall be in both the English and Chinese languages and contain the following text—
“警告
此產品不應直接接駁香港的電力供應
系統,否則可導致人身受傷
或財產受損。
WARNING
This product should not be connected directly to
the electrical supply system in Hong Kong,
otherwise personal injury or damage
to property may result.”;
(b)shall be with red text against a white background;
(c)shall be fixed durably and conspicuously on the surface of the packaging of the electrical product, or on the product itself if no packaging is provided when supplied;
(d)shall be of a size not less than—
(i)120 mm by 80 mm; or
(ii)one quarter of the area of the largest surface of the packaging of the electrical product; and
(e)(i)in the case of the size in paragraph (d)(i), the characters of the text shall not be less than 5 mm high and 8 mm high respectively for the word “WARNING” and the Chinese characters “警告” and not less than 3 mm high and 5 mm high respectively for the rest of the English wording and the Chinese characters; or
(ii)in the case of paragraph (d)(ii), the size of the English wording and the Chinese characters shall be adjusted in proportion to that specified in paragraph (e)(i). (E.R. 3 of 2021)

Organizations Qualified to Apply for Recognition as Recognized Certification Bodies
1.An organization which has been accepted as one of the National Certification Bodies.
2.An organization which has been granted accreditation by the HOKLAS Executive or the HKAS Executive. (L.N. 77 of 2000)
3.An organization which has been granted accreditation by an accreditation body.

Schedule 5
Requirements for Recognition as Recognized Manufacturers
A manufacturer applying for recognition as a recognized manufacturer shall satisfy the following requirements, namely—
(a)the manufacturer’s laboratory has obtained accreditation under—
(i)HOKLAS;
(ii)a laboratory accreditation scheme outside Hong Kong which has entered into a mutual recognition agreement with the HOKLAS Executive or the HKAS Executive; or (L.N. 77 of 2000)
(iii)a scheme for assessment of testing laboratory as listed in the publication of the International Directory of Laboratory Accreditation Systems published by the National Association of Testing Authorities of Australia amended from time to time; and
(b)the manufacturer shall have a quality system that conforms to ISO 9002 “Specification for Product and Installation” and a quality assurance certificate issued by a Quality System Registration Body as listed in the publication of the Directory of Quality System Registration Bodies published by the International Organisation for Standardization amended from time to time.
