The Mining Act 2009 is "an Act to repeal the Mining (Banaba Island Phospate Re-Mining Agreeement) Act 1988". The Act was passed to give effect to an agreement with an Australian company, Roche Bros Pty Ltd, which had hoped to undertake secondary mining on Banaba. Following a feasibility study undertaken by Roche Bros in 1989, the proposal was considered commercially unviable and the agreement lapsed, rendering the legislation no longer necessary.
