Measures for the Administration of Energy Efficiency Labels
Chapter 1 General Provisions
Article 1 This Regulation is formulated in accordance with the Energy Conservation Law of the People’s Republic of China, Product Quality Law of the People’s Republic of China and Regulations of the People’s Republic of China on Certification and Accreditation, with a view to strengthening the administration of energy conservation, promoting energy-saving technologies and upgrading energy efficiency.
Article 2 For the purpose of this Regulation, energy-efficiency label as mentioned refers to the label that provides information on energy-efficiency level of energy-consuming products, belonging to product labels indicating certain conformity.
Article 3 China has established a nationwide system of unified energy-efficiency labeling on energy-consuming products that are widely used and have greater energy-saving potential. The government develops and issues the List of Energy-Efficiency labeled Products of the People’s Republic of China (hereinafter referred to as the List), and publishes national energy-efficiency standards, the implementation rules, the label pattern and specifications for the label.
Article 4 Any product on the List shall present the unified label on conspicuous part of the product body or its smallest packaging; and relevant explanation shall be given in the product’s instruction book.
Article 5 Manufacturers or importers of the product on the List shall, once using the label, have the product and the necessary information registered in the registrar authorized by the National General Administration of Quality Supervision and Inspection and Quarantine (hereinafter referred to as AQSIQ), and the National Development and Reform Commission (hereinafter referred to as NDRC).
Article 6 AQSIQ, NDRC and the National Accreditation Certification Administration (hereinafter referred to as the CNCA) are responsible for developing and organizing implementation of the energy-efficiency labeling institution.
The local administration for energy conservation at various level (hereinafter referred to as local energy conservation administration), the local quality and technical supervision bureau and the local import and export inspection and quarantine bureau at various levels (hereinafter jointly referred to as local quality inspection bureaus), are responsible for supervision over the implementation of the energy-efficiency labeling within their respective jurisdiction.
Chapter 2 Implementation of Energy-Efficiency Label
Article 7 NDRC, AQSIQ and CNCA are responsible for developing the List and the implementation rules; NDRC and CNCA for formulating and publishing unified label pattern and specifications for the products to be labeled.
Article 8 The name of the energy-efficiency label is China Energy Label. Basic information to be provided on the label shall include:
1. Name or abbreviated name of the manufacturer of the product;
2. Specifications and model of the product;
3. Energy efficiency level of the product;
4. Energy consumption of the product;
5. Code of national standards applied.
Article 9 The manufacturer or the importer of the product on the list may use its own testing capacity or authorize a testing institution accredited by the government to test its products, so as to determine the energy-efficiency level of its products in accordance with applicable national energy efficiency standards.
Manufacturers or importers that test the energy efficiency level by themselves shall have adequate resources and capability of testing in compliance with relevant national standards. It is recommendable that their laboratories receive national accreditation by authorized accreditation bodies.
Article 10 Manufacturers or importers shall print and use energy efficiency labels in accordance with national regulations on the style, specifications and mark of energy efficiency labels.
Energy efficiency labels used in product packaging, manuals and advertising promotions shall be able to zoom in or out proportionally and be legible.
Article 11 The manufacturer or the importer shall register in the authorized registrar within 30 days after it uses the energy efficiency label and provide the following documents by means of mail, telegraph, telex, facsimile or e-mail:
1. Copy of the manufacturer’s business license or registration certificate; copy of concerning contracts that the importer has concluded with foreign manufacturers;
2. Test report of the product’s energy efficiency;
3. Sample of the energy efficiency label;
4. The date of first use and any other concerning documents;
5. In the case that a representative submits the filing documents on behalf of the manufacturer or the importer, an authorization of representative shall be provided.
The aforementioned documents shall be true, accurate and complete.
A Chinese version shall be submitted along with the documents originally written in foreign language, and the former shall prevail.
Article 12 The registration shall be renewed in the case that the contents of the label have changed.
Article 13 When any dispute arises over the energy-efficiency index of a product, the business shall engage a lawfully recognized or officially accredited third-party testing agencies to retest it and the retesting results shall prevail.
Article 14 The registrar shall release registration information regularly and verifying the energy efficiency label used by manufacturers or importers.
No fee shall be charged for the filing of the energy efficiency label.
Chapter 3 Supervision and Administration
Article 15 The manufacturer or the importer shall be responsible for the correctness of information with regard to the energy efficiency label that it uses. No forgery or infringement of energy efficiency label is permitted.
Article 16 Distributors shall not sell unlabeled products subject to the label, nor shall they forge or infringe energy efficiency label.
Article 17 Accredited testing laboratories that are commissioned by manufacturers or importers shall conduct the test objectively and fairly, ensure the correctness of test results, bear legal liabilities accordingly, and keep the commercial secrete of tested products confidential.
Article 18 No entity or individual is permitted to make false or misleading advertisement for its product(s) by taking advantage of the label.
Article 19 AQSIQ and NDRC shall inspect products on the List and verify the information associated with the label within their respective jurisdiction.
Article 20 Manufacturers, distributors and importers of products on the list are subject to supervision and inspection.
Article 21 Entities and individuals are encouraged to report violations of this Regulation to the local energy administration or quality/inspection bureaus. The latter shall make investigations and take necessary actions to the reported violation in a timely manner, and keep the reporter’s personal information secret.
Chapter 4 Penalties
Article 22 Local energy administrations and quality/inspection bureaus are responsible for imposing penalties on violations of this Regulation within their respective jurisdiction in accordance with concerning regulations of the Energy Conservation Law of the People’s Republic of China.
Article 23 In the case that a manufacturer or an importer fails to mark the label on the product as it should have, the local energy administration or quality/inspection bureaus shall order it to correct within a specified period of time and circulate a notice where the manufacturer or importer fails to correct within the specified period.
Article 24 Any violation of this Regulation under any of the following circumstances shall be subject to the injunction by the local energy administration or quality/inspection bureaus to take remedial measures within a specified period of time and suspend the label’s use; for serious violations, penalties can be imposed up to 10,000 Yuan:
1. Failure to file a labeled product or go through change formalities as should have;
2. Failure to comply with the style and specifications of the used energy efficiency labels.
Article 25 Any forgery, infringement or concealment of the energy efficiency label, or false advertisement to mislead consumers by taking advantage of the label shall be penalized by the local quality/inspection bureaus in compliance with the Energy Conservation Law of the People’s Republic of China, Quality Law of the People’s Republic of China and/or other applicable laws/regulations.
Chapter 5 Supplementary Provisions
Article 26 NDRC and AQSIQ are responsible for making explanations to this Regulation.
Article 27 This Regulation takes effect from Match 1st, 2005.
中华人民共和国国家发展和改革委员会 令 中华人民共和国国家质量监督检验检疫总局 第 17 号 为加强节能管理,推动节能技术进步,提高能源效率,依据《中华人民共和国节约能源法》、《中华人民共和国产品质量法》、《中华人民共和国认证认可条例》,特制定《能源效率标识管理办法》,该办法经7月13日国家发展和改革委员会主任办公会议和8月11日国家质量监督检验检疫总局局务会议审议通过,现予以发布,自2005年3月1日起施行。 发展改革委主任 马 凯 质 检 总 局 局 长 李长江 二○○四年八月十三日 能源效率标识管理办法 第一章 总 则 第一条 为加强节能管理,推动节能技术进步,提高能源效率,依据《中华人民共和国节约能源法》、《中华人民共和国产品质量法》、《中华人民共和国认证认可条例》,制定本办法。 第二条 本办法所称能源效率标识,是指表示用能产品能源效率等级等性能指标的一种信息标识,属于产品符合性标志的范畴。 第三条 国家对节能潜力大、使用面广的用能产品实行统一的能源效率标识制度。国家制定并公布《中华人民共和国实行能源效率标识的产品目录》(以下简称《目录》),确定统一适用的产品能效标准、实施规则、能源效率标识样式和规格。 第四条 凡列入《目录》的产品,应当在产品或者产品最小包装的明显部位标注统一的能源效率标识,并在产品说明书中说明。 第五条 列入《目录》的产品的生产者或进口商应当在使用能源效率标识后,向国家质量监督检验检疫总局(以下简称国家质检总局)和国家发展和改革委员会(以下简称国家发展改革委)授权的机构(以下简称授权机构)备案能源效率标识及相关信息。 第六条 国家发展改革委、国家质检总局和国家认证认可监督管理委员会(以下简称国家认监委)负责能源效率标识制度的建立并组织实施。 地方各级人民政府节能管理部门(以下简称地方节能管理部门)、地方质量技术监督部门和各级出入境检验检疫机构(以下简称地方质检部门),在各自的职责范围内对所辖区域内能源效率标识的使用实施监督检查。 第二章 能源效率标识的实施 第七条 国家发展改革委、国家质检总局和国家认监委制定《目录》和实施规则。国家发展改革委和国家认监委制定和公布适用产品的统一的能源效率标识样式和规格。 第八条 能源效率标识的名称为“中国能效标识”(英文名称为China Energy Label),能源效率标识应当包括以下基本内容: (一)生产者名称或者简称; (二)产品规格型号; (三)能源效率等级; (四)能源消耗量; (五)执行的能源效率国家标准编号。 第九条 列入《目录》的产品的生产者或进口商,可以利用自身的检测能力,也可以委托国家确定的认可机构认可的检测机构进行检测,并依据能源效率国家标准,确定产品能源效率等级。 利用自身检测能力确定能源效率等级的生产者或进口商,其检测资源应当具备按照能源效率国家标准进行检测的基本能力,国家鼓励其实验室取得认可机构的国家认可。 第十条 生产者或进口商应当根据国家统一规定的能源效率标识样式、规格以及标注规定,印制和使用能源效率标识。 在产品包装物、说明书以及广告宣传中使用的能源效率标识,可按比例放大或者缩小,并清晰可辨。 第十一条 生产者或进口商应当自使用能源效率标识之日起30日内,向授权机构备案,可以通过信函、电报、电传、传真、电子邮件等方式提交以下材料: (一)生产者营业执照或者登记注册证明复印件;进口商与境外生产者订立的相关合同副本; (二)产品能源效率检测报告; (三)能源效率标识样本; (四)初始使用日期等其他有关材料; (五)由代理人提交备案材料时,应有生产者或进口商的委托代理文件等。 上述材料应当真实、准确、完整。 外文材料应当附有中文译本,并以中文文本为准。 第十二条 能源效率标识内容发生变化,应当重新备案。 第十三条 对产品的能源效率指标发生争议时,企业应当委托经依法认定或者认可机构认可的第三方检测机构重新进行检测,并以其检测结果为准。 第十四条 授权机构应当定期公告备案信息,并对生产者和进口商使用的能源效率标识进行核验。 能源效率标识备案不收取费用。 第三章 监督管理 第十五条 生产者和进口商应当对其使用的能源效率标识信息准确性负责,不得伪造或冒用能源效率标识。 第十六条 销售者不得销售应当标注但未标注能源效率标识的产品,不得伪造或冒用能源效率标识。 第十七条 认可机构认可的检测机构接受生产者或进口商的委托进行检测,应当客观、公正,保证检测结果的准确,承担相应的法律责任,并保守受检产品的商业秘密。 第十八条 任何单位和个人不得利用能源效率标识对其用能产品进行虚假宣传,误导消费者。 第十九条 国家质检总局和国家发展改革委依据各自职责,对列入《目录》的产品进行检查,核实能源效率标识信息。 第二十条 列入《目录》的产品的生产者、销售者和进口商应当接受监督检查。 第二十一条 任何单位和个人对违反本办法的行为,可以向地方节能管理部门、地方质检部门举报。地方节能管理部门、地方质检部门应当及时调查处理,并为举报人保密。 第四章 罚 则 第二十二条 地方节能管理部门、地方质检部门依据《中华人民共和国节约能源法》的有关规定,在各自的职责范围内负责对违反本办法规定的行为进行处罚。 第二十三条 违反本办法规定,生产者或进口商应当标注统一的能源效率标识而未标注的,由地方节能管理部门或者地方质检部门责令限期改正,逾期未改正的予以通报。 第二十四条 违反本办法规定,有下列情形之一的,由地方节能管理部门或者地方质检部门责令限期改正和停止使用能源效率标识;情节严重的,由地方质检部门处1万元以下罚款: (一)未办理能源效率标识备案的,或者应当办理变更手续而未办理的; (二)使用的能源效率标识的样式和规格不符合规定要求的。 第二十五条 伪造、冒用、隐匿能源效率标识以及利用能源效率标识做虚假宣传、误导消费者的,由地方质检部门依照《中华人民共和国节约能源法》和《中华人民共和国产品质量法》以及其他法律法规的规定予以处罚。 第五章 附 则 第二十六条 本办法由国家发展改革委和国家质检总局负责解释。 第二十七条 本办法自2005年3月1日起施行。 |
