Notice of the National Development and Reform Commission, the State Electricity Regulatory Commission and the National Energy Administration on Issues concerning Regulating the Management of Prices for Electricity Trading
(No. 2474 [2009] of the National Development and Reform Commission)
The development and reform commissions, economic and trade commissions (economic commissions) and price bureaus of all provinces, autonomous regions and municipalities directly under the Central Government; all regional electricity regulatory bureaus, and all urban electricity regulatory offices; State Grid Corporation of China; China Southern Power Grid Co., Ltd.; Inner Mongolia Electric Power Corporation; China Huaneng Group; China Datang Corporation; China Huadian Corporation; China Guodian Corporation; and China Power Investment Corporation:
To further regulate conduct regarding prices for electricity trading, maintain normal order in market trading, and promote the optimized allocation of electric power resources, the relevant issues are hereby notified as follows:
I. Prices for Electricity Trading between Power Generation Enterprises and Power Grid Enterprises
1. After power generators are put into commercial operation, the on grid tariffs set by the competent price department of the government shall uniformly apply to the amounts of on grid electricity of the power generators, except in the case of trans provincial and trans regional electricity trading or where it is otherwise prescribed by the state.
2. Before power generators are put into commercial operation, the on grid tariffs during the trial operation period shall be implemented according to a fixed ratio with the local benchmark tariff for on grid power generated by coal fired generators using desulphurization. A 50% ratio shall apply to hydropower generators, and an 80% ratio shall apply to thermal power and nuclear power generators; and, expect for hydropower generators, the on grid tariffs approved by the competent price department shall be implemented for the renewable energy power generators from the first day of on grid power generation. Power grid enterprises shall pay power purchase fees on this basis and include them in power purchase costs.
3. When power generation enterprises initiate the commissioning phase or, due to their own cause, stop operations and purchase electricity from power grids, the tariff standards for the electricity grade for largescale industry listed in the local tariff catalogue shall be implemented.
4. For normal operation of coal fired generators that have installed desulphurization facilities and are equipped with functions for online monitoring, and which have passed the compliance inspections of the environmental protection department, the desulphurization price shall be increased from the first day the generators pass the compliance inspection; if the environmental protection department is unable to conduct compliance inspection on time, the competent price department at the provincial level shall advise the environmental protection department to notify power grid enterprises that the desulphurization price will be increased 30 working days after a power generation enterprise submits an compliance inspection application to the environmental protection department; for the enterprises failing to pass the compliance inspection of the environmental protection department, the increased desulphurization price shall be deducted accordingly. A power generation enterprise shall, when submitting a compliance inspection application to the environmental protection department, submit a copy to the competent price department at the provincial level and the electricity regulatory institution, and also record the initial electricity meter reading.
5. For substitute power generation or rights for power generation trading approved by the relevant department of the government, the power generation enterprise shall conduct settlement according to the amount of electricity traded and price agreed to by contract or agreement.
II. Trans provincial and Trans regional
Electricity Trading Prices
1. The price of received power for trans provincial and trans regional electricity trading is composed of the power delivery price, power transmission price (cost) and power transmission loss.
2. If the prices for trans provincial and trans regional electricity trading have been set by the state, such prices shall be strictly implemented. If the prices for transprovincial and transregional electricity trading have not been set by the state, the power delivery and receiving parties shall, by reference to the average on grid tariff in the power grid of the delivery terminal and the average power purchase tariff in the power generation plant and the power grid enterprise through consultation and under the guidance of the competent price department at the provincial level, the electricity regulatory institution and the power administration department in the power delivery and receiving regions. The power transmission price (including loss) of power grid enterprises in power delivery provinces (or autonomous regions and municipalities directly under the Central Government) shall not, in principle, exceed 0.03 yuan/kWh.
3. Power delivery prices for temporary trans provincial and trans regional electricity trading shall be determined according to the aforesaid principles. For emergency and accident aid trading, settlement shall be made at the agreed price if an agreement has been reached by the trading parties in advance; if no such agreement has been reached in advance, the power delivery price shall, in principle, be fixed at 120% of the benchmark on grid tariff of coal fired generators in the power grid where the power purchaser is located. Emergency and accident trading shall be exempt from power transmission fees.
4. Aside from trans provincial and trans regional electricity trading prescribed by the state, power grid enterprises shall not, at the same point in time, conduct sham trading and relay power delivery without the physical flow of electricity with each other for the purpose of reducing the on grid tariffs of power generation enterprises.
5. If the power tariffs on the amount of electricity purchased from another province by power grid enterprises in the power receiving province (or autonomous region or municipality directly under the Central Government) differ from the average power purchase tariffs in the receiving province, the price shall be included in the receiving province’s sales tariff plan for balancing.
6. Provincial power grid enterprises shall summarize trans provincial and trans regional electricity trading on a monthly basis, report the trading of the previous month to the competent price department at the provincial level, power administration department and electricity regulatory institution prior to the 15th day of each month. The State Grid Corporation of China and China Southern Power Grid Co., Ltd. shall report quarterly and annually on trans provincial and trans regional electricity trading to the National Development and Reform Commission, the State Electricity Regulatory Commission and the National Energy Administration. All power grid companies shall, prior to the 20th day of each month, release to all interested parties the quantity of traded electricity, power delivery price, power transmission cost, power transmission loss, electricity purchase sources, electricity sales destination and other trading circumstances of the previous month.
7. Power enterprises shall keep detailed dispatching and transaction records of trans provincial and trans regional energy trading, including quantity of traded electricity, price, electricity transmission cost, electricity transmission loss, electricity purchase sources, electricity sales destination and contact line port metering data, and accept the supervision and inspection of relevant departments of the government and the electricity regulatory institution.
III. Prices for Trading between Power Grid Enterprises and End Users
1. The sales tariffs charged by power grid enterprises from power users shall be strictly governed by the tariff standards issued by the National Development and Reform Commission. Governments at all levels and power grid enterprises shall neither increase nor reduce the sales tariffs charged from power users at their own discretion, nor offer tariff preferences under the guise of direct power purchases (or direct power supply) by large users.
2. All localities shall step up efforts to continue implementing differential tariffs according to the requirements of the Notice of the General Office of the State Council on Forwarding the Opinions of the National Development and Reform Commission on Improving Differential Tariff Policies (No. 77 [2006] of the General Office of the State Council) and the Notice of the National Development and Reform Commission, the Ministry of Finance and the State Electricity Regulatory Commission on Issues concerning Further Implementing Differential Tariff Policies (No. 2655 [2007] of the National Development and Reform Commission). All localities shall strengthen the dynamic supervision over high energy consumption enterprises and update in a timely manner the list of enterprises implementing differential tariffs, so as to ensure the effective implementation of differential tariff policies.
3. Enterprises possessing their own power plants shall install electricity measuring meters at the generator terminal, and their quality of self-utilized electricity shall be verified by the relevant department of the government and the electricity regulatory institution. Such enterprises shall also, according to the provisions of the document No. 2 [2007] of the State Council, pay into governmental funds and pay surcharges prescribed by the state such as the Three Gorges Project construction fund, the rural power grid loan repayment fund, urban public utility surcharges, renewable energy power tariff surcharges and the fund for follow-up support to reservoir migrants, and local power grid enterprises shall be the responsible agents for collecting the aforesaid funds and turning them over to the higher authorities. Enterprises possessing their own power plants connected to public power grids shall pay the system reserve fees as required.
IV. Other Matters
1. In case of any discrepancy between this Notice and the existing measures and provisions, this Notice shall prevail.
2. Competent price departments of governments and electricity regulatory institutions shall supervise and inspect the implementation of prices for electricity trading.

有关问题的通知

各省、自治区、直辖市发展改革委、经贸委(经委)、物价局,各区域电监局、城市电监办,国家电网公司、南方电网公司,内蒙古电力公司,华能、大唐、华电、国电、中电投集团公司:
为进一步规范电能交易价格行为,维护正常的市场交易秩序,促进电力资源优化配置,现就有关问题通知如下:
一、关于发电企业与电网企业的交易价格
(一)发电机组进入商业运营后,除跨省、跨区域电能交易及国家另有规定的以外,其上网电量一律执行政府价格主管部门制定的上网电价。
(二)发电机组进入商业运营前,其调试运行期上网电价按照当地燃煤发电机组脱硫标杆上网电价的一定比例执行。其中,水电按照50%执行,火电、核电按照80%执行;水电以外的可再生能源发电机组自并网发电之日起执行价格主管部门批复的上网电价。电网企业据此支付购电费,并计入购电成本。
(三)发电企业启动调试阶段或由于自身原因停运向电网购买电量时,其价格执行当地目录电价表中的大工业类电度电价标准。
(四)燃煤发电机组安装脱硫设施、具备在线监测功能且运行正常的,已经环保部门验收合格的,自环保部门验收合格之日起执行脱硫加价;环保部门不能按时验收的,由省级价格主管部门商环保部门通知电网企业,自发电企业向环保部门递交验收申请之日起30个工作日后执行脱硫加价;经环保部门验收不合格的,相应扣减已执行的脱硫加价。发电企业向环保部门递交验收申请时应抄送省级价格主管部门和电力监管机构,并抄录电能表起始表示数。
(五)经政府有关部门批准的替代发电或发电权交易中,发电企业按照合同或协议约定的交易电量和价格进行结算。
二、关于跨省、跨区域电能交易价格
(一)跨省、跨区域电能交易的受电价格由送电价格、输电价格(费用)和输电损耗构成。
(二)跨省、跨区域电能交易国家已规定价格的,要严格按照国家规定的价格执行。国家尚未规定价格的,在送电、受电地区省级价格主管部门、电力监管机构和电力管理部门的指导下,由送受双方参考送端电网平均上网电价和受端电网平均购电电价协商确定厂网间结算电价。其中,送电省(区、市)电网企业的输电价格(含损耗)原则上不得超过每千瓦时3分钱。
(三)跨省、跨区域电能临时交易的送电价格按照上述原则确定。紧急情况及事故支援交易,事先交易各方有约定的,按照约定价格进行结算;事先没有约定的,原则上按照购电方所在电网燃煤机组标杆上网电价上浮20%确定。紧急情况及事故交易免交输电费。
(四)除国家规定的跨省、跨区域电能交易外,电网企业之间不得以降低发电企业上网电价为目的,在同一时点相互进行没有电能物理流量的虚假交易和接力送电。
(五)受电省(区、市)电网企业购外省电量的电价与本省平均购电价有差异的,纳入本省销售电价方案进行平衡。
(六)省级电网企业每月汇总本省的跨省、跨区域电能交易情况,并于每月15日前将上一月度的交易情况报省级价格主管部门、电力管理部门和电力监管机构。国家电网公司、南方电网公司将季度、年度跨省、跨区域交易情况,报国家发展改革委、国家电监会和国家能源局。各电网公司应当在每月20日前,向各利益相关方公布上一月度的交易电量、送电价格、输电费用、输电损耗、购电来源、售电去向等交易情况。
(七)电力企业要保留跨省、跨区域电能交易的详细调度、交易记录,包括交易电量、价格、输电费用、输电损耗、购电来源、售电去向、联络线关口计量数据等内容,接受政府有关部门和电力监管机构的监督检查。
三、关于电网企业与终端用户之间的交易价格
(一)电网企业对电力用户的销售电价,要严格按照国家发展改革委颁布的电价标准执行。各级政府和电网企业不得自行提高或降低电力用户销售电价,不得自行以大用户直购电(或直供电)等名义实行电价优惠。
(二)各地要按照《国务院办公厅转发发展改革委关于完善差别电价政策意见的通知》(国办发[2006]77号)和《国家发展改革委、财政部、电监会关于进一步贯彻落实差别电价政策有关问题的通知》(发改价格[2007]2655号)要求,继续加大差别电价贯彻落实力度。要加强对高耗能企业的动态监管,及时更新执行差别电价的企业名单,确保差别电价政策执行到位。
(三)拥有自备电厂的企业,应在发电机端加装电能量计量表计,自用电量由政府有关部门和电力监管机构核定,并按照国发[2007]2号文件规定交纳国家规定的三峡工程建设基金、农网还贷资金、城市公用事业附加费、可再生能源电价附加、水库移民后期扶持资金等政府性基金及附加,并由当地电网企业负责代征并上缴。拥有自备电厂并与公用电网连接的企业,应按规定支付系统备用费。
四、其他事项
(一)现有办法和规定与本通知不一致的,按本通知规定执行。
(二)政府价格主管部门、电力监管机构依法对电能交易价格执行情况进行监督检查。
