Overall Summary: 
Present Law establishes an extensive institutional and regulatory framework for the exploration of hydrocarbon - oil and gas - resources in the Republic of Turkmenistan. The policy carves the niche for the fundamental objective of environmental protection, seeks to ensure that national hydrocarbon resources are used in a sustainable manner. Aspects under consideration include oil and gas infrastructure development being an essential component for fostering economic growth.
Environment
Energy environmental priorities: 
Art. 42-45 call for strengthening the national system of environmental protection, including environmental monitoring and improving control of all sources of pollution, develops measures for assessment of accidental pollution impacts and provides for incident response plans. The policy seeks to provide solutions to the complex and interconnected issues of atmospheric air pollution, soil and water contamination, etc.--- An excessive emphasis is placed on specifications of a licensing agreement for hydrocarbons exploration and exploitation. (Provisions for service contracts or other forms of contracting are contained in the policy document as well.)
Pollution control action plans: 
The policy seeks to provide solutions to the complex and interconnected issues of atmospheric air pollution, soil and water contamination, etc.
Pricing
Energy pricing: 
Art. 39 highlights the issues related to determination of tariff setting. Export tariff for the transportation of hydrocarbons by transmission pipelines shall be set by pipeline owner and are subject to approval of the Agency.
Energy Supply and Infrastructure
Infrastructure development priorities: 
Art. 27 stipulates that regulatory oversight shall be applied to infrastructural projects on the construction of oil exploration facilities and objects - including those ones in the Turkmen sector of the Caspian Sea and inland water reservoirs. Contractor shall prove ability to meet environmental protection requirements. --- Art. 40. With a view to ensure the safety of hydrocarbon products transportation, the policy tightens technical norms and requirements for construction and operation of transmission pipelines.
Cross-border energy infrastructure: 
Art. 37 para 2 states that property rights for export pipeline belong to the state, unless otherwise provided by a decision of the Cabinet of Ministers (Government) of the Republic of Turkmenistan.
Governance
Energy institutional structures: 
Art.7. State Agency for the Management and Use of Hydrocarbon Resources under the President of Turkmenistan was set up with the following objectives: set rules for the exploration of hydrocarbon resources ensuring consistency with best international practice (oil extraction), develop tender specifications and license agreements; control oil exploration activities in accordance with legislation of the Republic of Turkmenistan.
