ROYAL DECREE ORGANIZING DEPARTMENT OF ENERGYDEVELOPMENT AND PROMOTIONMINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENTB.E. 2537 (1994) BHUMIBOL ADULYADEJ, REX. Given on the 16th day of July B.E. 2537 (1994) Being the 49th year of the Pres His Majesty King Bhumibol Adulyadej has been graciously pleased to proclaim that : Whereas it is expedient to organize the Bureau of the Department of Energy Development and Promotion, Ministry of Science, Technology and Environment. His Majesty the King, by virtue of Section 175 of the Constitution of the Kingdom of Thailand and Section 8 Para 4 of the Administration Regulation Act B.E. 2534 (1991), is graciously pleased to enact this Royal Decree as follows : Section 1 This Royal Decree shall be called “Royal Decree Organizing Department of Energy Development and Promotion, Ministry of Science, Technology and Environment B.E. 2537 (1994).” Section 2 This Royal Decree shall come into force on the day following the date of its publication in the Royal Gazette. Section 3 The Department of Energy Development and Promotion, Ministry of Science, Technology and Environment is authorized to perform the following duties : (1) To perform activities as prescribed in the Law of Energy Development and Promotion as well as the Law of Energy Conservation Promotion and other related Laws. (2) To perform other activities as stipulated to be the functions of the Department of Energy Development and Promotion, or the activities assigned by the Ministry or the cabinet. Section 4 The Department of Energy Development and Promotion, Ministry of Science, Technology and Environment shall be divided as follows : 1.Office of the Secretary 2.Finance Division 3.Work Plan Division 4.Training Division 5.Design Division 6.Bureau of Energy Regulation Conservation 7.Bureau of Energy Development and Maintenance 8.Bureau of Energy Study, Research and Development 9.Office of Energy Cooperation 10-13. Regional Office of Energy Development and Promotion 1-4 Section 5 The functions of the Department of Energy Development and Promotion, Ministry of Science, Technology and Environment shall be as follows : (1) Office of the Secretary is authorized to perform general department affairs or any other which is not assigned to any particular division or bureau. Such duties are as follows : (a) To deal with the Department’s documentary works. (b) To execute the Department’s administrative and secretarial works. (c) To manage the Department’s work system and personnel administration. a. To manage the Department’s welfare system. b. To disseminate information on the Department’s operation as well as its activities, progress and work results. c. To execute all legal works within the Department’s responsibilities,other related laws, legal acts and contracts, works that are related to the civil obligation and legal works within the responsibilities of the department. d. To cooperate with or support the operation of other related or assigned offices. (2) Finance Division is authorized : (a) To perform duties relevant to financial matters, accounting, budget, inventory, office buildings and vehicles of the department excluding the annual budgeting plan preparation. (b) To cooperate with or support the operations of other related or assigned offices. (3) Work Plan Division is authorized : (a) To prepare and coordinate the plan of operation of the Department to be in line with the Ministry’s policy and master plan as well as to expedite, monitor and evaluate the operation of the offices being under control. (b) To prepare the annual budgeting plan and to report on its annual budgeting disbursement. (c) To formulate the system of survey, data collection and utilization of the offices being under control, to prepare an annual energy information report, to act as an energy information center and to handle library work of the Department. (d) To set up the system of utilization and maintenance of the Department computer. (e) To cooperate with or support the operations of other related or assigned offices. (4) Training Division is authorized : (a) To conduct and develop training in the fields of energy management and technology for personnel in the government and private sectors. (b) To train personnel who are responsible for energy in accordance with the Energy Conservation Promotion Act. (c) To cooperate with or support the operations of other related or assigned offices. (5) Design Division is authorized : (a) To prepare engineering and architectural designs as well as specifications and cost estimation of projects of the Department. (b) To set up criteria for engineering and architectural designs including a standard cost per unit. (c) To provide comments on the design, specifications and cost estimation of projects. (d) To conduct a quality test on engineering materials. (e) To cooperate with or support the operations of other related or assigned offices. (6) Bureau of Energy Regulation and Conservation is authorized : (a) To develop, promote and supervise energy conservation and perform other functions relating to Energy Conservation Promotion Act. (b) To undertake responsibilities relating to permission of regulated energy production and expansion including supervision of work as well as to set up criteria and standards on regulated energy in accordance with the Energy Development and Promotion Act. (c) To coordinate and propose plans on energy conservation. (d) To cooperate with or support the operations of other related or assigned offices. (7) Bureau of Energy Development and Maintenance is authorized : (a) To operate the construction and maintenance of the production, and transformation of energy sources as well as the transmission and utilization of energy system. (b) To determine remuneration rates for the utilization of energy operated by the Department (c) To perform and coordinate management of land ownership to facilitate construction of energy generating sources. (d) To determine regulations and standards on the production, transformation, transportation, utilization and distribution of energy as well as to set up outlines for the regulation of operation and maintenance of projects undertaken by the department and to supervise enforcement of such regulations and standards. (e) To make available, supervise, construct, buy, sell, rent, lease out, transfer or accept transferals of the production and transformation of energy sources as well as the transmission and distribution energy system. (f) To cooperate with or support the operations of other related or assigned offices. (8) Bureau of Energy Study, Research and Development is authorized : (a) To research, develop, experiment, demonstrate and initiate pilot projects related to production, transformation, transportation, utilization, distribution, and conservation of energy sources, and to provide energy technology transfer, energy promotion and publication, as well as to act as a center for cooperation on related activities. (b) To conduct surveys and examine energy sources, energy production, transformation, transportation and utilization for planning and energy projects. (c) To collect and analyse hydrological and meteorological data for energy development. (d) To conduct feasibility study and formulate energy projects and related activities. (e) To cooperate with or support the operations of related or assigned offices. (9) Office of Energy Cooperation is authorized : (a) To associate and coordinate work with international organizations on energy assistance and cooperation. (b) To organize meetings and seminars and to conduct negotiation as assigned. (c) To perform secretarial works of a committee(s), a sub-committee(s) and working committee(s) on energy activities. (d) To cooperate with or support the operations of other related or assigned offices. (10)-(13) Regional Offices of Energy Development and Promotion 1-4 are authorized : a. To prepare a plan of operation and budget for the administration of regional offices; to survey and collect data on energy development and promotion ad well as to monitor and evaluate the operation of the plan within the responsible areas. b. To promote energy conservation in accordance with the Energy Conservation Promotion Act, and to manage the regulated energy to be in line with the Energy Development and promotion Act within the responsible areas. c. To manage work in relation to promotion and development of production sources, procurement and utilization of energy in a particular area by demonstrating energy technology to the people within the responsible areas. d. To manage the production of energy and maintenance of sources for energy production and utilization within the responsible areas. e. To operate the expansion of the irrigation distribution system and electrical pumping for irrigation service to agriculturists within the project areas. f. To cooperate with or support the operations of other related or assigned offices. Section 6 The Minister of Science, Technology and Environment shall act according to this Royal Decree. Remark :- The Reason for the promulgation of this Royal Decree is that, whereas it is expedient to organize the Bureau within the Department of Energy Development and Promotion, Ministry of Science, Technology and Environment, and to prescribe the authority of each particular bureau to conform with the nature of work, as well as Section 8 Para 4 of the Government Administration Act B.E. 2534 (1991) stipulated that, the Organization of Bureau within the Department shall be made by the issue of the Royal Decree with the prescription the authority of each bureau therein, the enactment of this Royal Decree is necessary. |
