On labeling for energy used facilities and equipment

Pursuant to Decree No. 189/2008/ND-CPon 27th December, 2007 of the Government stipulating functions, duties, powers and organizational structure of the Ministry of Industry and Trade; Decree No. 44/2011/ND-CP amending, supplementing Article 3 of Decree No. 189/2007/ND-CP on December 27, 2007 of the Government stipulating functions, duties, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Law on Energy thrifty and efficient use of June 28 2010;

Pursuant to Decree No. 21/2011/ND-CP on March 2911\ 2011 regulating details and measures for the Law on Energy Thrifty and Efficient Use;

Minister of Industry and Trade provides regulation on labeling for energy used vehicle and appliances as follows:

Chapter I GENERAL PROVISIONS

Article 1. Governing scope

This Circular regulates procedures for registration, evaluation, certification, suspension of certificates, nomination for conducting test and energy labeling for vehicle and appliances under obligatory energy labeling list, issued by the Prime Minister or other voluntary energy labeling (hereinafter referred to as vehicle, equipment).

Article 2. Target of application

This Circular shall be applied to:

1. The manufacturer, importer (hereinafter referred to as enterprises), vehicle and appliances specified in Article l .
2. The nominated testing organizations which participate in testing energy-labeled vehicle and equipment.
3. The agencies managing energy labeling activities and other related agencies, organizations and individuals.

Article 3. Term explanation

In this Circular, the following abbreviations are understood as follows:

1. Energy  labeling  means  sticking,  gluing,  printing  and  engraving  energy  labels  on products, packing.

1. ILAC: International Laboratory Accreditation Cooperation.
2. LAC: Asia Pacific Laboratory Accreditation Cooperation.
   1. VILAS: Vietnam Laboratory Accreditation Scheme.
   2. ISO: International Organization for Standardization.
      1. IEC: International Electro technical Commission.

7. TCVN:  Vietnam standards.

Article 4. Principles and labeling certification mode for vehicles, appliances using energy

1. The base for testing, evaluating and certificating energy saving vehicle and appliances is Vietnam standards or respective regulations of the Ministry of Industry and Trade.
   1. Testing organizations are those, which meet the conditions according to regulations, and  are nominated  by the Ministry of Industry and Trade.
      1. Procedure for certification of productive vehicle and appliances includes:

a)     Testing the typical samples;

b)     Assessing manufacturing conditions (in manufacture);

c)     Issuing certificate with 3 year validity;

d)      Monitoring  products,  goods after receiving certification;

1. Certification mode of imported vehicle and appliances includes:

a)     Testing typical samples;

b)      Assessing actual status (warehouse, ground);

c)     Issuing certificate for each lot.

Chapter II

CONDITIONS, ORDER, PROCEDURES FOR NOMINATING TESTING ORGANIZATION AND ACKNOWLEDGMENT OF TESTING RESULTS CONDUCTED BY TESTING ORGANIZATIONS

Article 5. Conditions for nominating testing organizations

1. Capable independent testing organizations under VILAS system, which are recognized in accordance with ISO / IEC 17025 standard or foreign testing organizations accredited by the accreditation organizations, which sign mutual recognition agreements (ILAC or APLAC).
   1. Testing organizations, which are not recognized according to standards of VILAS, TCVN ISO / IEC 17025 systems or foreign testing organization capable to conduct testing on energy consumption of vehicles and appliance include:

a)    Having properly trained staff and specialized in testing vehicle and equipment;

b)      Having laboratory equipment in good operation with the maintenance, inspection, calibration· in accordance with regulation and having enough precision in order to perform the testing norms;

c)     Having enough equipment in accordance with the requirements of testing standards;

d)      Having adequate procedures and guideline for testing;

e)      Making and keeping necessary records: training record of testing staff; records for monitoring verification, calibration; maintenance of testing equipment and testing activities (if any).

Article 6. Procedures for nominating  testing organization

1. Testing organizations that expect to involve in testing activities for labeling should make registered application documents and send to the General Department of Energy.
   1. Application documents comprise:

a)   Copy of certificate of registered testing fields m accordance with Circular No 08/2009/TT-BKHCN of April 8, 2009 guiding requirements and procedures for the registered fields for conformity assessment activities.

b)   Registration  form nominating    energy  label  testing  organizations  as sample in Appendix I;

c)   List of testing staff of nominated registered testing organization as sample in Appendix 2;

d)  A list of documents, standards, procedures for testing assample in Appendix 3;

e) Testing forms and reports;

e) Documents and certificates to be used as evidence (if any);

g) Testing activity results in a last year (if any).

1. Within no more than twenty working days after receiving sufficient and valid application forms, The General Department of Energy reviews this documents, evaluates the actual competence at the facility in order to submit the decision of nominating testing organization to the Ministry of Industry and Trade. Decision takes effective no more than 3 years.

In case of refusing nomination, the General Department of Energy informs testing organization in writing form.

1. At least three months before expiry of the Decision for nominating testing organization, testing organization shall have to carry out re-registration procedures and submit application documents regulated in Item 2 of this Article if it has needs.
   1. In caseof changing or supplementing the nominated fields, testing organization shall have to carry out registration procedures for changing or supplementing (new registration) and submit application documents regulated in Item 2 of this Article.

Article 7. Recognizing the testing results of the foreign organizations

Testing results of energy saving vehicle and appliances conducted in foreign countries shall be accepted when meeting following conditions:

1. Foreign related testing organization must be an independent organization accredited under ISO / IEC 17025 standard (or equivalent) by the accreditation organizations which signed mutual recognition agreements (ILAC or APLAC) .

1. Foreign related testing organization shall have to register for nomination with The General Department of Energy following the procedures regulated in Article 6 of this Circular.

3.Application documents comprise:

a)  Copy of the certificate of legal status or similar documents;

b)  Application documents for nominating energy label testing organizations as the form regulated in Appendix 1;

c) List of testing personnel of the testing organization as theform regulated in Appendix 2;

d)  The list of documents, standards, procedures for testing as the form regulated m Appendix 3;

e)  Testing sheet and reports;

e) Certificate of recognition of accreditation organizations (if any);

g) Results of testing activities in a last year (if any).

Application documents shall have to be translated into Vietnamese and notarized.

1. The tests must be consistent with the testing method specified in TCVN and other relevant re!:r,ulations.

Chapter IV

ORDERS AND PROCEDURES FOR EVALUATION, GRANTING CERTIFICATE AND ENERGY LABEL

Article 8. Assessment procedures and certificate grant of energy label

Enterprises producing, importing vehicles and appliance under the list regulated in Article l of this Circular participate in the process of certification and energy labeling (confirmation label or comparison label) should perform following steps:

1. Testing typical samples: Enterprise themselves takes sample of vehicle and appliances; number of sample and collecting methods shall be conformable with standards or regulations of the Ministry of Industry and Trade and sent to the testing organization which is nominated by the Ministry of Industry and Trade to conduct tests base on the correlative standards to provide testing result sheet.

2.                  Making application form and sending to the General Department of Energy with following documents:

a)                  Energy labeling Registration form for vehicle, appliance using energy, which clearly states that enterprise registers compared label or confinned label according to the form stipulated in Annex 4 enclosed with the list of vehicles, appliances:

b)             Business registration certificate (notarized copy);

c)           Copies of contracts with overseas goods suppliers (for importers) and imported goods declaration;

d)         Trade mark registry certificate;

d)  A statementof the quality of products and goods (copies stamped and certified by the head of the Enterprise), a brief description of the typical, basic parameters of the vehicle and appliance;

e)     Test results issued by the testing organization with limited term (not over 6 months since the date of issuance);

g)  Application documents , documents and process of quality management of the Enterprise;

h)  Record, document,squality management procedures of the enterprise.

i)  Documents, relavent quality management certificates;

In case the application documents are applied by agencies on behalf of overseas manufacturers, such agencies shall have to show authorized document. If above application forms and documents written in foreign languages, such documents shall have to be translated into Vietnamese and notarized.

1. Assessment for certification:

a)  Within 10 (ten) working days after receiving completed application forms, General Department of Energy reviews application forma , assesses enterprise's capability and compatibility of the application forms, test results in comparison with the evaluation standards; define energy consumption level compared with published standards;

b)  After having appropriate result of application form, the General Department of Energy assesses actual status of enterprises registering in energy labeling and makes decision to certify energy saving appliances.

1. Issue certification of energy label

In case, the result of application documents  meets requirements:

a)         For importers, the Ministry of Industry and Trade makes decisions to issue energy-label certification for registered vehicle and appliance.

Certificate isonly valid for each imported lot of goods. For following lot of goods, which have the same origin, manufacture without technical changes affecting the certificate requirements, importing  enterprises submit  report  to the General Department of Energy    in order to get new certificate from the Ministry of Industry and Trade. If there is a change in the origin or factory locations or model or technical design, vehicle and equipments must be re-evaluated and re-certified;

b)     For manufacturers, the Ministry oflndustry and Trade decides to issue energy-label certificate. Certificate is valid in maximum 03 (three) years. Energy-label certificate follows the form regulated in Annex 5 of this Circular. Three months before expiry of certificate, enterprises shall have to submit application document for re-certification.

In case, assessment result does not meet requirements, General department of Energy shall inform enterprise by document stating clearly reasons.

Article 9. Using energy labels

1. Energy labels shall be used in accordance with the regulation of Ministry of Industry and Trade, format and samples must follow specimen regulated in Appendix 6 of this Circular. Energy labels shall have to contain the following basic information:

a)  Full name or abbreviated name of the manufacturer;

b)  Name and code of vehicles and appliances;

c)  Certification code issued by the Ministry of Industry and Trade, the date of issuance;

d)  Information on energy consumption;

e)  Standard or regulations.

The specific technical information for each vehicle and appliance shall be specified in the appendix of the decision for certifying energy label.

1. After issuing certification for energy label, Enterprises themselves print energy labels and paste to registered vehicle and appliance according to energy consumption level stated in the issued certificate.
   1. Energy labels pasted to vehicle, appliance or to package shall have appropriate size which change by ratio of enlargement or reduction. Labels should not cause confusion, hiding or affecting to the information written in the goods label according to legal regulations.
      1. When certificate is expired, the Enterprise should not conduct continue energy labeling and shall have to reregister certificate.

Article 10. Re-certification

1. Enterprise shall  have to re-register certificate in one of the following cases:

a)  Expired certificate;

b) Change of assessment standards;

c)  Certified vehicles and appliance have energy consumption changes;

d) Contents of goods label change;

e)  Change of the production venue. 

1. Contents and re-registration procedures shall have to follow as the first registration procedure.

Chapter VI

INSPECTION, MONITORING, SUSPENSION AND REVOCATION OF CERTIFICATION  FOR  ENERGY LABEL

Article 11. Post certification inspection and monitoring

1. The Ministry of Industry and Trade actively coordinates with concerned ministries and agencies to check sample of vehicle and appliances in the market or in production site regularly or suddenly.

1. Annually, enterprises which have been granted certificate and have conducted energy labeling are responsible for making report on quantity, types of vehicles, appliance which have been produced, consumed and energy labeled in a year according to the form regulated in annex 7 and sending to General department of Energy and Department of Industry and Trade before January 01 of the following year.
   1. Complaints of organizations and individuals about energy labeling should be sent to the General Department of Energy to deal with according to law on complaints.
   2. Sample of energy-labeled vehicles and appliance with complaint are stored and checked at independent testing organization.
      1. In case, samples of tested vehicle and appliances do not requirements, the General Department of Energy considers increasing quantity and sample trucing method .
         1. Organizations and individuals, Enterprise shall have to shoulder all the testing cost in case the complaint is not true.
         2. Organizations, individuals and Enterprise having facility, energy-labeled equipment shall have to bear all the testing cost, costs relating to fixing mistakes, punishment types additional fines according to the Law in case equipment does not meet standard.

Article 12. Complaints and dealing with complaints

Article 13. Management of testing activities

l. Once a year, nominated testing organizations are responsible for making report on quantity, typeof vehicle, appliance under the tested labeled list according to the form in Annex 8 and sending to the General department of Energy.

2. Ministry of Industry and Trade shall decide to suspend the energy-label test when the testing organization has one of the foUowing actions:

a)  Providing incorrect or fake test results;

b) Do not submit periodical reports according to the regulation of this circular or do not to comply with instructions and administration of the state authorities;

c)  No longer have qualified testing capacity according to regulation.

Article 14. Suspending the use of energy labels

1. Ministry of Industry and Trade shall decide to stop energy labeling activities when Enterprise has one of these following actions:

a)  Pasting energy labels without energy label certification;

b)  Printing labels with wrong specifications, designs and improperly using label with an aim of causing misunderstanding for customers.

c)  Wrong expression of energy consumption level written in the Certificate issued by the Ministry of Industry and Trade;

d)  Using energy labels for other objects which are different from registered and certified vehicles and appliance;

d) Using expired or erased certificate;

e)  Having changes in designing and manufacturing vehicle, appliance which reduce energy consumption however such changes are not re-registered with General department of Energy;

g)  Not making report according to regulation;

h) Result of actual test is not correct with energy output of registered vehicle and appliance;

2. Enterprise which is suspended energy label should not continue to conduct energy labels pasting until the completion measure overcoming violations.

Article 15. Revocation of energy label certificate

1. The Ministry of Industry and Trade decides to revoke the energy label certificate when Enterprise  has one of the following actions:

a)  Not following requirements mentioned in the energy label suspension in time;

b) Being deceitful in energy label application documents.

1. Decision to withdraw the energy label certificate shall be simultaneously sent to the Vietnam Standards and Consumers Association and uploaded to the Website of the Ministry of Industry and Trade and website of the General Department of Energy.

Chapter VII IMPLEMENTATION

Article 16. Responsibilities of the General Department of Energy

1. Develop annual plan for energy label, plan of building energy efficiency standards; assess and nominate the testing organizations.

2. Give advice to the Ministry of Industry and Trade in collaboration with the Ministry of Science and Technology to develop, promulgate, and amend the National Standards for energy efficiency and methods of determining energy efficiency.

3. Receive application documents  for energy label certification.

1. Receive application documents nominating testing organization for vehicles and appliance using energy.
   1. Evaluate capacity, quality assurance conditions in manufactures, conduct testing imported enterprises and conditions affecting to energy outputs, quality of registered vehicle, appliance.
   2. Manage, inspect and monitor activ1t1es of the nominated testing organization; enterprises having vehicle, appliance with energy label on markets, monitor sample selection process for testing of enterprises.
      1. Coordinate with relevant agencies to deal with complaints and disputes related to the registration, evaluation, certification, certificate grant and energy labeling.

8. Inspect energy label activities, propose measures dealing with correct complaints to The Industry and Trade Mjnistry or inform organizations, individuals in case of incorrect complaints

1. Publish detailed information about registration procedures, the detailed application forms for labeling vehicles and appliance using energy in the website of the Ministry of Industry and Trade and the General Department of Energy.

10. Request enterprise to withdraw vehicle and appliances pasted energy label improperly which circulate in the market.

11. Propose the Ministry of Industry and Trade to suspend the use of energy labels in case Enterprise  does not make report after 90 days as in Clause I of Article 18 of this Circular.

Article 17. Responsibilities of the Department of Industry and Trade

1. Conduct inspection, supervision and monitoring label activities of imported, exported enterprises and suppliers of vehicle, appliance under the list of energy labeled equipment in local area

2. Receive and summary report of enterprises on produced or imported vehicles, appliances under the list of energy labeled equipment annually and the list of energy labeled vehicle and appliance in a year and send to the Ministry of Industry and Trade before March 15 of the following years..

1. Deal with, propose measures, check the overcoming violation of enterprises located in provincial area, which violate energy label and report to the Ministry of Industry and Trade.
2. Propose the Ministry of Industry and Trade to suspend the use of energy labels in case Enterprise does not make report after 90 days as regulated in Item I of Article 18 of this Circular.
   1. Implement other management and supervision activities under the authorization of the Ministry of Industry and Trade. 

Article 18. Responsibilities of the Enterprise

1. Make periodical reports on quantity and types of vehicles and appliance which is manufactured, sold and affixed energy saving label and send report to the Depa11ment of Industry and Trade where Enterprise locates before 15th January every year.
   1. Promptly report to the Ministry oflndustry and Trade the changes of technology criteria, the impact of increasing or decreasing energy consumption target of vehicles and equipment; implement certificate re-registration as in the provisions of Article 10 of this Circular when there are changes in design and technology affecting to energy consumption.

3. lnitiatively report to the Ministry of Industry and Trade and the local authorities in order to jointly carry out remedial measures for vehicles and appliance which are being manufactured, imported or distributed; Initiatively report vehicles and appliance which are on the market as well as vehicles and appliance which are being used have unsuitable expression to respective standard evaluation.

1. Immediately stop energy labeling on vehicles , equipment, and send reports to the Ministry of Industry and Trade and propose solution when a decision suspending the use of energy labels is given.

5. Regularly implement and maintain measure to ensure vehicle, appliance meeting energy saving registered standards and certified in the certificate.

6. Recall energy labeled vehicle, appliance of enterprise, which circulate in the market.

Article 19. Validity for implementation

1. This Circular shall take effect on 19th  May 2012.

1. During implementation, organizations, individuals should report troubles or arising problems to the Ministry of Industry and Trade for timely solving. /.

Annex 6: Specification of energy label sample

1. Confirmed energy label
2. Confirmed energy label is label, which show energy saving symbol (or Viet Energy Star) pasted in vehicles, appliances circulating in the market when such vehicles, appliances reach energy efficiency regulated by the Ministry of Industry and Trade by each period.
3. Color, size of confirmed energy label are regulated in detail as follows:

Propotion and size

The letter Tiet kiem Nang luong has been developed from font style Furtura MdCn Bt.

Symbol of energy confirmed label shall be used in many types fo product with different sizes, therfore sizeof symbol also may chang to be appropriate with each type of product

Symbol has been recommended to use as follows: Minimal label size is 9 x 10mm

Larger printing size shall depend on conformity with available printing area of the product.

1. Compared energy label
   1. Compared energy label is the label, which pastes in vehicles, appliances circulating in the market to provide information of energy efficiency of such vehicles and appliance compared with the same types in the market. It helps consumers select the vehicles, appliances that have more energy saving level.

Different energy efficiency is corresponded with fivelevel of energy efficiency shown by the energy efficiency.

1. Information displayed in the label:

Energy compared label includes following minimal information:

a)    Certified code: the code provided by the Ministry of Industry and Trade in order to serve management activities, which stipulates in detail in the Certificate of Energy Saving Product;

b)    Product name/ code: the code or name, which enterprise registers to label and issued by the Ministry of Industry and Trade in the Certificate of Energy Saving Product;

c)    Manufacturer: the name of organization, enterprise producing energy label registered product;

d)    Importer: the name of importing organization, enterprise, which import the energy label registered product (this information is only applied for importer);

e)    Parts showing assessment indicators of energy saving level (energy efficiency level): the levels of energy consumed in a hour of operating the same type products produced by different manufacturers are divided into 5 levels corresponding with the number of starts on

the Ministry of Industry and Trade through testing energy efficiency indicators of product showing in the Certificate of energy saving product.

f)     Energy consumption level of product: value of energy consumption is calculated by kWh/year;

g)    Other information: is regulated in detail in the Decision on granting certificate appropriate with each specific product.
