ELECTRIC POWER BOARD (SUBMARINE CABLES) BY-LAWS

Made by the Tonga Electric Power Board under section 63 of the Tonga

Electric Power Board Act and continued in force under section 2(2) of Act

12 of 2007 ¹

Commencement [28th February, 1979]

1. These By-laws may be cited as the Electric Power Board (Submarine Cables) By-laws.

2. It shall be lawful for the Tonga Electric Power Board to lay submarine and underwater cables for the conduction of electricity.

3. The Board shall by reasonable means and at a reasonable time before the laying of any submarine or underwater cable and before the commencement of conduction of electricity through such cable notify the public of the same.

4. The Board shall erect warning signs in respect of each stretch of submarine or underwater cable as follows:

(a) one sign over the cable at each end of the stretch, and

(b) one sign over the cable half-way between the signs erected under (a) above.

Each sign shall have a red light which shall be so mounted and maintained at all times of the day and night as to be visible from either of the other two lights.

5. Any submarine or underwater cable which may have been laid or used prior to the date of commencement of these By-laws shall be deemed to have been laid or used in pursuance of the same:

Provided that the warning signs and lights mentioned in By-law 4 hereof have been erected and the public reasonably notified.

6. There shall be no fishing of any description, mooring, anchoring or beaching Of any ship, boat, canoe or vessel within 30 metres of a straight line between the signs erected over any cable laid in pursuance of these By-laws.

7. Any person acting in contravention of these By-laws or who acts in circumstances which may be dangerous either to any cable or to any life or property shall be guilty of an offence and shall be liable on conviction thereof to a fine not exceeding $20.
