The Mining Act 2009 is "an Act to repeal the Mining (Banaba Island Phospate Re-Mining Agreeement) Act 1988". AN ACT TO REPEAL THE MINING (BANABA ISLAND

PHOSPHATE RE-MINING AGREEMENT) ACT 1988

1. Short title

This Act may be cited as the Mining (Banaba Island Phosphate Re—mining Agreement) (Repeal) Act 2009.

2. Repeal of the Mining (Banaba Island Phosphate Re—mining Agreement) Act 1988

The Mining (Banaba Island Phosphate Re—mining Agreement) Act 1988 is repealed.

EXPLANATORY MEMORANDUM

Section 2 of this short Act repeals the Mining (Banaba Island Phosphate Re-mining Agreement) Act 1988. The Act was passed to give effect to an agreement with an Australian company, Roche Bros Pty Ltd, which had hoped to undertake secondary mining on Banaba. Following a feasibility study undertaken by Roche Bros in 1989, the proposal was considered commercially unviable and the agreement lapsed, rendering the legislation no longer necessary.
