§7201. Authority. The Guam Energy Office under the authority of Guam Public Law 12-110, as amended promulgates these Rules and Regulations.
§7202. Purpose. The purpose of these Rules and Regulations is to establish procedural requirements for energy rebates funded under Guam or Federal authorities. Should a Federal regulation exist for specified Energy Rebates along with specified funding to Guam, the Federal Regulations shall control.
§7203. Intent. The intent of these rules and regulations is to promote energy conservation, energy efficiency, and energy renewables for best use and acceptance of smart green technology to the general island population.
§7204. Definitions. For the purposes of this chapter, the following definitions shall apply:
1. Natural person shall mean a human being.
2. Purchaser shall mean the natural person who purchased a new qualified equipment for which an application for the Program is made.
3. Qualified Plug-In Electric Drive Motor Vehicle shall mean a new vehicle with at least four wheels that draws propulsion using a traction battery that has at least four-kilowatt hours (kWh) of capacity, uses an external source of energy to recharge the battery, has a gross specified emission standard.
§7205. Procedures for Rebates. An application for rebates shall be filed with the Guam Energy Office or the authorized vendor on a form approved by the Director of the Guam Energy Office. As a minimum, the application form shall include:
a) Full Name of Purchaser(s);
b) Contact Information (Home, Work, and Cell);
c) Home and Mailing Address;
d) Purchase Date;
e) Make, Model, Vehicle Identification Number, Engine Number, and Vehicle Weight;
f) Authorized Dealership Information.
§7206. Procedure: Participating Vendor. Shall be in accordance with Chapter 1, Title 7 GARR.
§7208. Procedure: Requirement. As a condition for receiving Guam rebate funds, the applicant must comply with the requirement below. The applicant is responsible for reviewing the program requirement prior to applying for a rebate. Eligible applicant(s) must meet the following requirement:
a) Be a bona fide resident of Guam. Proof of Guam residency required.
b) Businesses, fleets and other commercial entities may participate if eligible under a specified rebate program.
c) Eligible equipment can only be purchased through the Guam Energy Office’s registered authorized Vendor’s List.
d) Active duty military members with permanent residency in Guam are eligible to apply.
e) The Purchaser may submit a rebate application through the authorized dealer or retailer. The participating authorized dealer or retailer will transmit the rebate application to GEO for pre-approval or approval.
f) For direct rebate request through GEO, the applicant must be a purchaser and submit the rebate application to Guam Energy Office.
g) Equipment purchase date must be on or after the effective date of a funded rebate program.
h) The Purchaser shall not make or allow any modifications to the equipment’s system for other than its intended purpose.
i) Retain ownership of the equipment for a minimum of 36 consecutive months immediately after the purchase date.
j) Depending on equipment type, the Purchaser shall provide proof of insurance coverage to the GEO for the 36 months or as required by law. The GEO shall make the determination on insurance coverage requirement.
k) If the equipment is required to be register by Guam law, the Purchaser shall provide proof of registration to GEO for a minimum of 36 consecutive months for use in Guam.
l) The Guam Energy Office requires participation from rebate recipients on research efforts that support the Rebate Program goals.
§7206. Procedure: Application. A standard rebate application form shall be provided, which, in addition to that information normally required for rebates.
§7209. Procedure: Approval. The Director of the Guam Energy Office or his designated designee shall approve all application.
§7210. Procedure: Exceptions. There shall be no exceptions except as provided for law.
§7211. Energy Rebate Programs. Each rebate program established shall be appendix to the Guam Energy Rebate Rules and Regulations.

§7212. Amendments. Amendments are authorized under Article 3 (Rule Making Procedures), Chapter 9 (Administrative Adjudication Law), Title 5 (Government Operations) Guam Code Annotated.
