EXECUTIVE ORDER NO. 433
DIRECTING THE IMMEDIATE IMPLEMENTATION OF ADDITIONAL ENERGY CONSERVATION MEASURES
WHEREAS, the current uncertain situation in the Gulf continues to affect the country’s oil supply situation;
WHEREAS, in order to stretch supply and thus prevent depletion of our petroleum products inventories, the government has directed the oil companies to reduce by ten percent (10%) all sales and deliveries to petroleum fuel resellers, distributors, marketers, retailers including bulk sales to industrial/commercial or agricultural customers and other agencies/corporations, or individuals directly withdrawing their petroleum product requirements from oil companies depots, bulk plants and other storage and distribution facilities;
WHEREAS, it is necessary that the mandated reduction in petroleum fuel supplies be complemented by additional energy conservation measures;
NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:
SECTION 1. All departments, agencies, offices, government-owned and/or controlled corporations, local government units and other government instrumentalities shall adopt additional measures to limit the use of their petroleum products supplies to essential activities properly authorized by their respective heads.
Accordingly, they shall seek to increase the mandated 10% and 5% reductions in electricity and fuel consumption by all departments, agencies, offices, government-owned and/or controlled corporations, local government units and other government instrumentalities provided under Section 1 of Executive Order No. 418, S. of 1990, to 15% and 10%, respectively.
SEC. 2. Air-conditioning units in all government offices shall be switched on at the start of office hours but not earlier than 8:00 a.m. and shall be put off one (1) hour before the regular closing hour. This is in addition to what is required under National Emergency Memorandum Order (NEMO) No. 17, S. of 1990, that air-conditioners shall be put off except air handling units in centralized air-conditioning systems during lunch breaks. For window-type and package-type air-conditioning systems, the units shall be switched to “FAN” only.
Private buildings and offices are hereby encouraged to adopt similar measures on the use of their air-conditioning units considering that statistics show significant energy savings through the regulated use of air-conditioning units in buildings as the latter accounts about 60% of their total power consumption.
SEC. 3. The Department of Trade and Industry shall, in consultation with appropriate trade and industry associations, continue to develop energy conservation programs for their respective members which shall now target the 15% and 10% reduction in electricity and petroleum products consumption and pinpoint responsibility for monitoring and reporting of performance.
SEC. 4. The Office of Energy Affairs shall continue to require industrial, commercial and transport establishments consuming annually more than one million fuel oil equivalent liters of energy including liquid fuels and electricity to submit an energy conservation program which shall target a 10% cutback in fuel consumption and a 15% reduction in electricity usage. In the case of industrial companies utilizing mainly electricity in their operation, appropriate conservation targets shall be adopted taking into account the realistic usage thereof in coordination with the Office of Energy Affairs.
SEC. 5. There is hereby mandated for nationwide compliance the following measures which:
a. Daily screening time of moviehouses shall be from 12:00 noon to 9:00 p.m. only.
b. Department stores and supermarkets shall operate from 10:00 a.m. to 8:00 p.m. Monday to Sunday.
c. Outdoor signs and lights for identification purposes shall be turned off by 9:00 p.m. except those necessary for security reasons and signs of establishments solely used as hospitals, sanitaria, medical centers and funeral parlors. Establishments using decorative lights are enjoined to desist from using the same until the energy situation normalizes.
d. Neon lights and other electricity-using signs for advertising purposes shall be used from 6:00 p.m. to 9:00 p.m. only.
For the effective enforcement of the measures enumerated above, local government units are urged to enact the necessary ordinances that would ensure compliance therewith by providing sanctions and penalties including suspension or closure of those establishments found to be habitually violating the herein set forth energy conservation measures.
SEC. 6. The Department of Transportation and Communications shall accelerate the adoption and implementation of reasonable measures restricting the use of motor vehicles during peak hours of the day and during Sundays and legal holidays or over certain streets during stated hours, so as to conserve fuel.
SEC. 7. The Energy Regulatory Board is hereby requested to consider the adoption of measures restricting the operating hours of petroleum products retail outlets (gasoline stations) including their closure during Sundays and holidays, taking into consideration the necessary safeguards that will ensure the proper distribution of petroleum fuels by gasoline stations especially to jeepneys and other vehicles used for mass transportation.
SEC. 8. All the concerned sectors are hereby urged to cooperate fully in the nationwide energy conservation effort.
