AN ACT

To amend the Petroleum (Prospecting and Mining) Act

[Assented to 21 December 1981)

BE it enacted by the Legislative Assembly of the Northern Territory of Australia, with the assent as provided by the Northern Territory (Self-Government) Act 1978 of the Commonwealth, its follows:

1. SHORT TITLE

This Act may be cited as the Petroleum (Prospecting and Mining) Amendment Act (No. 2) 1981.

2. PRINCIPAL ACT

The Petroleum (Prospecting and Mining) Act is in this Act referred to as the Principal Act.

3. GRANT OF LEASES

Section 46 of the Principal Act is amended -

(a) by omitting from sub-section (2) paragraphs (a) and (b) and substituting the following:

"(a) shall be subject to such terms and conditions as the Minister determines by notice in writing served on the applicant prior to the granting of the lease; and"; and

(b) by omitting sub-section (8).

4. CANCELLATION OF LEASE

Section 54 of the Principal Act is amended -

(a)by inserting in sub-section (2) after "a default by the lessee" the words "in complying with the terms and conditions to which the lease is subject"; and

(b)by omitting from sub-section (2) “60 days” and substituting "30 days".

5. DUTIES OF LESSEE

Section 55 of the Principal Act is amended -

(a) by inserting in sub-section (1) after "A lessee shall," the words "if requested or instructed so to do by the Minister,"; and

(b) by omitting sub-section (4) and substituting the following:

"(4) Notwithstanding anything contained in this section, the Minister may direct that any of the operations referred to in sub- sections (1), (2) and (3) not be pursued in the development of the lease area and may give such other directions as are appropriate or necessary in the circumstances."

6. TENDERS FOR SURRENDERED OR CANCELLED LEASES

Section 59(5)(a) of the Principal Act is amended by omitting "in addition to the prescribed terms and conditions" and substituting "in addition to the terms and conditions determined by the Minister under section 46(2), or the terms and conditions as varied by the Minister under section 70, for the surrendered, cancelled or expired lease".
