PETROLEUM (PROSPECTING AND MINING) REGULATIONS

1. CITATION
These Regulations may be cited as the Petroleum (Prospecting and Mining) Regulations. (See back note 1)
2. INTERPRETATION
(1) In these Regulations "the Act" means the Petroleum (Prospecting and Mining) Act.
(2) In these Regulations a reference to a form by number is a reference to the Form so numbered in the Schedule.
3. APPLICATIONS FOR PERMIT
(1) An application for a permit by an individual shall be in accordance with Form 1.
(2) An application for a permit by an association of individuals or bodies corporate or of individuals and bodies corporate shall be in accordance with Form 4.
(3) Each member of the association shall make a declaration in Form 4A or 4B as the case may require and each declaration so made shall be lodged with the application and shall be deemed to be incor -porated in and form part of the application.
(4) An application for a permit by a body corporate shall be in accordance with Form 7.
(5) An application for a permit in accordance with Form 1, 4 or 7 shall be in duplicate and shall be accompanied by 2 copies of a plan and description of the land applied for.
(6) A statement such as required by section 25 of the Act in support of an application for a permit or an extension of a permit may be -
(a) in the case of an application by an individual - in accordance with Form 2;
(b) in the case of an application by an association of individuals or bodies corporate or of individuals and bodies corporate - in accordance with Form 4C; and
(c) in the case of an application by a body corporate - in accordance with Form 7A.

5. APPLICATIONS FOR LEASES
(1) An application for a lease by an individual shall be in accordance with Form 3.
(2) An application for a lease by an association of persons or of bodies corporate or of persons and bodies corporate shall be in accordance with Form 6 and shall be accompanied by a declaration in Form 6A or 6B made by each member of the association as the case may require and each declaration so made shall be lodged with the application and be deemed to be incorporated in and form part of the application.
(3) An application for a lease by a body corporate shall be in accordance with Form 9.
(4) An application for a lease in accordance with Form 3, 6 or 9 shall be in duplicate and shall be accompanied by 2 copies of a plan and description of the land applied for, each plan and description being in accordance with a survey made by a surveyor approved by the Minister for the purposes of these Regulations.
6. EXECUTION OF APPLICATION FOR PERMIT; OFFENCES
(1) A person shall not furnish to the Minister an application for a permit or lease which contains a statement which is false in any particular.
Penalty: $100.
(2) A person shall not furnish to the Minister or make a declaration which is false in any particular.
Penalty: $200.
(3) A person shall not fail to do what he has undertaken to do in any undertaking given by him in any declaration or application made under the Act or these Regulations.
Penalty: $200.
7. FORM OF NOTIFICATION OF APPLICATIONS
A notification of the issue or grant of a permit or lease, published in accordance with section 12 of the Act, may be in or to the effect of Form 32.
8. FORM OF PERMIT
A permit granted under section 21 of the Act shall be in accordance with Form 18.
9. FEE FOR EXTENSION OF PERMIT
The fee payable in respect of an extension of a permit shall be $40.
10. STATUTORY DECLARATION TO SUPPORT APPLICATION FOR WAIVER, SUSPENSION OR REDUCTION OF RENT, &c.
An application for the waiver, suspension or reduction of rent or royalty, or rent and royalty, shall be supported by a statutory declaration setting out the facts relied on by the applicant to show that the waiver, suspension or reduction is applied for in order to promote the development of the lease or because the lease cannot be successfully operated under the terms provided for in the lease.
11. STATUTORY DECLARATION TO SUPPORT APPLICATION FOR SUSPENSION OF OBLIGATIONS
An application by a permittee or lessee for the suspension of obligations under his permit or lease shall be supported by a statutory declaration verifying the grounds of the application.
12. STATUTORY DECLARATION TO SUPPORT APPLICATION FOR VARIATION
An application by a permittee or lessee for the variation of the terms and conditions of his permit or lease shall be supported by a statutory declaration verifying the grounds of the application.
13. FORM OF LEASE
In addition to the rights and obligations given to or conferred upon the Minister and a lessee respectively under the Act a lease granted in pursuance of section 46 of the Act shall be -
(a) in accordance with Form 22; and
(b) subject to the terms and conditions specified in the Schedule to the Act.
14. APPLICATION FOR RENEWAL OF LEASE
An application for a renewal of a lease under section 50 of the Act shall be in accordance with Form 12.
15. EMPLOYMENT OF GEOLOGISTS
(1) A permittee or lessee shall employ in the investigation of the area included in the permit or lease or in the development thereof only those geologists, geophysicists or petroleum technologists whose names have been specified in the application for the permit or lease as the case may be or whose names have been notified in writing to the Director of Mines.
Penalty: $100.
(2) Where any geologist, geophysicist or petroleum technologist ceases to be employed in the investigation or development of the area included in a permit or lease the permittee or lessee shall within 14 days of his ceasing to employ that person notify the Director of Mines of that fact.
Penalty: $100.
16. USE OF APPROPRIATE FORMS WHERE FORM APPROVED BY MINISTER
Where any act, application or return is required or permitted by the Act to be evidenced by, made or furnished in a form approved by the Minister, and a form appropriate to that act, application or return is contained in the Schedule it shall be sufficient if that act, application or return is evidenced by, made or furnished in that form.
17. USE OF APPROPRIATE FORM WHERE FORM IS NOT ESSENTIAL
Where an act, application or return is not required to be evidenced by, made or furnished in a prescribed form or a form approved by the Minister but an appropriate form is contained in the Schedule the appropriate form in the Schedule may be used according to its tenor.
18. FEE FOR REGISTRATION OF A DEALING
The prescribed fee for the registration of a dealing in relation to a permit or lease, or any rights arising from a permit or lease, is $5.
19. FEE FOR CERTIFIED COPY
The prescribed fee for a certified copy of -
(a) an entry in the Register of Permits or Register of Leases; or
(b) a registered document,
shall be one dollar per page or part thereof of such entry or registered document.
20. FEE ON CONSENT
The prescribed fee in respect of an application for the consent of the Minister under section 72 of the Act is $5.
