The National Executive Councils Decree No. 331 determines that "in the case where a private individual invests of joint invests of joint invests with the Defence Energy Department, Ministry of Defence, to explore and produce petroleum in the areas that the Defence Energy Department, Ministry of Defence, has been assigned to operate, the provisions of Division 6 of the Petroleum Act B.E. 2514 on the Benefits, Rights and Duties of the Concessionaire shall apply to such private investor or joint investor as if such private investor or joint investor were the concessionaire under the Petroleum Act B.E. 2514".

Whereas the National Executive Council finds that as it is the policy of the Government to encourage private sector to invest or joint invest with the Defence Energy Department, Ministry of Defence, in connection with petroleum operation for the exploration and production of petroleum in the areas that the Defence Energy Department has been assigned to operate, it is therefore deemed proper that such investors or joint investors receive the same benefits, rights and duties as those concessionaires under the Petroleum Act B.E. 2514 [...]
