Classification of Types of Economic Activities

The Republic of the Union of Myanmar, Myanmar Investment Commission in exercise of the powers conferred under paragraph 56(b) of the Foreign Investment Law, with the approval of the Government, announces the List of Prohibited Economic Activities, List of Economic Activities allowed in the form of Joint Venture with Myanmar citizens and List of Economic Activities which shall be allowed under the specific circumstances, which are stipulated in Chapter 2 of Foreign Investment Law.

List of Economic Activities under Prohibition

4.	Installation of Factory in Myanmar utilizing of the imported wastes.

Manufacturing of chemicals which can cause ozone depletion such as 34 kinds of Hydrobromo fluoro-carbon (HBFC), Bromo-chloromethane(1), Chloroflurocarbon(5), Halogenated (CFC)(10), Halon(3), Halogenated CFC(10), Carbon tetrachloride(1) which are strictly prohibited in accordance with Vienna Convention and Montreal Protocol to Ozone Protection and its amendments
6.	Manufacturing of 21 types of organic compound which are prohibited by Stockholm Convention referring to the prevention of organics which are long lasting and polluted to the environment.
7.	Manufacturing of hazardous material which are not incompliance with the environmental and conservation Law, Rules and Procedures promulgated from time to time

Application for extension of afore mentioned permits shall be submitted 3 months before expiry.
	2	Large scale production of mineral	Require to obtain of the approval of the Union Government. The term will be allowed for 15 years. Extension can be applied once in 5 years, extension 4 times allowed. The extension must be applied 6 months in advance before the expiry term for large scale production. Mining life can be allowed with assessing of the latest estimated are reserves and production target.

5		Ministry of Industry
	1	Processing, manufacturing and marketing of oil and fats from vegetables, animals and other substances	Local raw materials must be used at least 80%
	2	Manufacturing and marketing of soft beverages, aerated and non-aerated products	Local raw materials must be used at least 20%. Local cropping raw materials must be used at least 60% after 3 years factory completion. They must be environmental friendly factories.
	3	Production of seasoning powder	To convert production stage by primarily used local raw materials within first 3 years.
	4	Manufacturing of cigarette	The raw materials must be used at least 50%, which is bought by the income earned after exporting local Virginia. And then exporting 90 %. The list of local raw materials to be used and exporting program must be attached in the investment proposal.
	5	Manufacturing and marketing of perfume and cosmetics	Local raw materials must be used 50% within 5 years after the construction of factory.
	6	Production and marketing of explosive chemicals. (TNT, Nitro-glycerin, Ammonium Nitrite)	To allow to do joint venture with the State.
	7	Production and marketing of flammable liquid and solid.(Titanium Powder), self reactive substance (Potassium Sulfide), substance which is contact with water, emit flammable gases (Calcium Phosphide)	To be allowed Joint Venture with the State.
